The Oklahoma Horse Racing Commission may authorize an\n\norganization licensee to accept wagers on the results of out-of-\n\nstate full racing programs for simulcast races as follows:\n\n1. On days when the organization licensee is conducting live\n\nracing, the licensee may accept wagers on out-of-state full racing\n\nprograms during the hours when it is conducting live racing, and may\n\naccept wagers on the results of out-of-state full racing programs\n\nduring the hours it is not conducting live racing;\n\n2. a. On days when the organization licensee is not\n\nconducting live racing, the licensee may accept wagers\n\non the results of out-of-state full racing programs,\n\nprovided that the number of days, not included in its\n\nrace meeting, which an organization licensee may be\n\nauthorized to accept wagering pursuant to this\n\nparagraph is limited to fifty percent (50%) of the\n\nnumber of days the licensee conducts live racing;\n\nb. notwithstanding the limitations contained in\n\nsubparagraph a of this paragraph, an organization\n\nlicensee may accept wagers on races run at any\n\nracetrack licensed by the Oklahoma Horse Racing\n\nCommission, and may accept wagers on the out-of-state\n\nfull racing programs received by said racetrack; and\n\n3. On days when the licensee is conducting live racing, the\n\nOklahoma Horse Racing Commission may authorize the organization\n\nlicensee to accept wagers on individual out-of-state simulcast races\n\nin addition to the out-of-state full racing programs.\n\nB. The authorization provided in subsection A of this section\n\nmust comply with federal laws including, but not limited to, Chapter\n\n57 of Title 15 of the United States Code.\n\nC. Wagers on out-of-state races conducted pursuant to the\n\nprovisions of this section may be placed in a separate pari-mutuel\n\npool or pools, or may be combined with the pari-mutuel pool or pools\n\nof the track where the race is run, or may be combined with other\n\norganization licensees licensed by the Oklahoma Horse Racing\n\nCommission and their wagering facilities located within this state.\n\nD. Each organization licensee accepting wagers on an out-of-\n\nstate race shall deduct a percentage of the amount handled which is\n\nequal to the percentage deducted from the amount handled by the\n\norganization licensee in pari-mutuel pools at the race meeting or\n\nmeetings held by the organization licensee if the wagers on the out-\n\nof-state races are not being combined with the pari-mutuel pool or\n\npools where the race or races are being run.\n\nE. For the day on which the out-of-state race is offered, each\n\norganization licensee shall pay the state share of the organization\n\nlicensee at the rate applicable to the races of the racing program\n\nof the organization licensee.\n\nF. Breakage and unclaimed ticket proceeds shall be distributed\n\nin the manner applicable to the races of the racing program of the\n\norganization licensee.\n\nG. Except as otherwise provided by law, the amount remaining\n\nfrom the deduction pursuant to the provisions of subsection D of\n\nthis section after payment of the state share and the contractual\n\npayment to the out-of-state host racing organization, shall be\n\ndistributed as follows:\n\n1. Fifty percent (50%) to the organization licensee; and\n\n2. Fifty percent (50%) to the organization licensee to be\n\ndistributed as purses.\n\nH. An organization licensee accepting wagers on out-of-state\n\nfull racing programs pursuant to subsection A of this section shall,\n\nfor any year in which it intends to accept such out-of-state full\n\nracing programs, make application to the Commission for not less\n\nthan eighty percent (80%) of the number of live racing days awarded\n\nfor each race meeting to that licensee in 1996.\n\nI. Notwithstanding subsection H of this section, any\n\norganization licensee may apply for less than the eighty percent\n\n(80%) of the number of live race days for a designated race meeting\ncept such out-of-state full\n\nracing programs, make application to the Commission for not less\n\nthan eighty percent (80%) of the number of live racing days awarded\n\nfor each race meeting to that licensee in 1996.\n\nI. Notwithstanding subsection H of this section, any\n\norganization licensee may apply for less than the eighty percent\n\n(80%) of the number of live race days for a designated race meeting\n\nawarded to the licensee in 1996 if such application is approved by\n\nthe organization licensee's official horsemen's representative at\n\nthat designated race meeting.\n\nJ. One-tenth of one percent (1/10 of 1%) of the total monies\n\nwagered at the racing enclosure on out-of-state simulcast races\n\nshall be remitted by the organization licensee from the amount\n\nretained pursuant to this section to the State Auditor and Inspector\n\nfor the purpose of auditing racing facilities.\n\nK.
