Each organization licensee shall utilize a Horsemen's\n\nBookkeeper who shall, at a minimum, maintain the records and\n\naccounts prescribed in this section or in the rules of the Oklahoma\n\nHorse Racing Commission. The Horsemen's Bookkeeper may be an\n\nemployee of the organization licensee, may be employed jointly by\n\ntwo or more organization licensees, or may be an entity which\n\ncontracts with one or more organization licensees.\n\nB. The records of the Horsemen's Bookkeeper shall include the\n\nfollowing:\n\n1. The name, mailing address, social security number or federal\n\ntax identification number, and the state or country of residence of\n\neach horse owner, trainer, and jockey participating at a race\n\nmeeting who has funds due or on deposit in a horsemen's account; and\n\n2. All statements of partnerships, syndicates, corporations,\n\nassignments of interest, lease agreements, and registrations of\n\nauthorized agents.\n\nC. All records of the Horsemen's Bookkeeper shall be kept\n\nseparate from the records of the organization licensee or licensees.\n\nD. All funds on account with the Horsemen's Bookkeeper shall be\n\nmaintained as follows:\n\n1. In one or more trust accounts which are separate from all\n\naccounts of the organization licensee with each designated as a\n\n\"Horsemen's Trust Account\"; and\n\n2. In trust accounts which are fully insured by the Federal\n\nDeposit Insurance Corporation or the Federal Savings and Loan\n\nInsurance Corporation.\n\nE. 1. The Horsemen's Bookkeeper shall receive, maintain, and\n\ndisburse the purses of each race and all stakes, entrance money,\n\njockey fees, purchase money in claiming races, along with all\n\napplicable taxes and other monies that properly come into the\n\npossession of the Horsemen's Bookkeeper.\n\n2. All disbursements pursuant to this subsection shall be made\n\nwithin forty-eight (48) hours of approval by the stewards unless a\n\nprotest or appeal has been filed with the stewards or the\n\nCommission, except that minimum jockey mount fees may be disbursed\n\nprior to such approval. All disbursements subject to a protest or\n\nappeal shall be made within forty-eight (48) hours of receipt of a\n\ndismissal or a final non-appealable order disposing of such protest\n\nor appeal.\n\n3. Except as otherwise provided in this subsection and in the\n\nabsence of a prior request, all disbursements pursuant to this\n\nsubsection shall be made within fifteen (15) days after the last\n\nrace day of the race meeting. Disbursements made by the Horsemen's\n\nBookkeeper for an amount less than Fifty Dollars ($50.00) and which\n\nremain uncashed after a period of not less than three (3) years may\n\nbe canceled by the Horsemen's Bookkeeper with the approval of the\n\nofficial horsemen's representative organization and the Oklahoma\n\nHorse Racing Commission provided the funds are credited back for use\n\nas a payment of purses for participating horses of the same breed.\n\nF. The Horsemen's Bookkeeper may accept, hold, and pay monies\n\ndue and belonging to other organizations, licensees, or meetings;\n\nprovided, prompt payment or return shall be made to the person or\n\nentity to which it is due.\n\nG. All records of the Horsemen's Bookkeeper shall be subject to\n\ninspection and audit by the Commission at any time.\n\nH. The Horsemen's Bookkeeper and the organization licensee or\n\nlicensees employing the Horsemen's Bookkeeper shall be subject to\n\ndisciplinary action by the Commission.\n\nI. The Horsemen's Bookkeeper, each organization licensee\n\nemploying the Horsemen's Bookkeeper, and the managing officers of\n\neach organization licensee employing the Horsemen's Bookkeeper,\n\nshall be jointly and severally responsible to ensure that the\n\namounts retained from the pari-mutuel handle are distributed\n\naccording to the Oklahoma Horse Racing Act and the orders and rules\n\nof the Commission.","path":["OK Code","Title 3A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os3A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"5c879abf8eb4268d11ebaeccc4e3ea628f6c90d5e0e7ccd5acb69b9f06f3dc64","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-3a-3a-208.12","next":"us-ok/okla.-stat.-tit.-3a-3a-208.2"},"notice":"GroundRules: Original legal text.
