There is hereby created in the State Treasury an agency\n\nspecial account for the Oklahoma Horse Racing Commission, to be\n\ndesignated the \"Oklahoma Breeding Development Fund Special Account\".\n\nThe fund shall be a continuing fund, not subject to fiscal year\n\nlimitations, and shall consist of all monies received by the\n\nCommission for deposit in the fund pursuant to Section 205.6 of this\n\ntitle and from revenue received as breakage and from unclaimed pari-\n\nmutuel tickets. All monies accruing to the credit of the fund are\n\nhereby appropriated and may be budgeted and expended by the\n\nCommission for the purposes specified in subsection B of this\n\nsection. Expenditures from the fund shall be made upon vouchers\n\nprescribed by the State Treasurer and issued by the Commission\n\nagainst the Oklahoma Breeding Development Fund Special Account. The\n\nofficial registering agency designated by the Commission pursuant to\n\nsubsection D of this section shall verify the current eligibility of\n\na participating horse prior to distributing any purse supplement,\n\nstake, reward or award from the Oklahoma Breeding Development Fund\n\nSpecial Account. Any person entitled to monies from the Oklahoma\n\nBreeding Development Fund Special Account as a purse supplement,\n\nstake, reward, or award (awards), will forfeit such monies if that\n\nperson fails to comply with all requirements necessary for earning\n\nthe awards. Further, any such person will forfeit such monies if,\n\nwithin one (1) year from the date of the race in which such award\n\nwas earned, that person does not submit the state voucher for\n\npayment or for replacement in the event of an expired voucher, or if\n\nthat person fails to submit all documentation required by the\n\nOklahoma Horse Racing Commission. In such event, monies accrued\n\nfrom forfeiture will be returned to the Oklahoma Breeding\n\nDevelopment Fund Special Account for expenditure by the Commission\n\nfor the purposes specified in subsection B of this section.\n\nB. No monies shall be expended by the Commission from the\n\nOklahoma Breeding Development Fund Special Account except for any of\n\nthe following purposes:\n\n1. To provide purse supplements to owners of Oklahoma-bred\n\nhorses;\n\n2. To provide stakes and rewards to be paid to the owners of\n\nthe winning Oklahoma-bred horses in certain horse races;\n\n3. To provide stallion awards to the owner of the Oklahoma\n\nstallion which is the sire of an Oklahoma-bred horse if such a horse\n\nwins any race conducted at a race meeting;\n\n4. To provide breeders awards to the owner of the Oklahoma-\n\nregistered mare which is the dam of an Oklahoma-bred horse if such a\n\nhorse wins any race conducted at a race meeting;\n\n5. To provide monies for equine research through state\n\ninstitutions accredited for the same;\n\n6. To provide monies for use in marketing, promoting and\n\nadvertising the Oklahoma-Bred Program and the Oklahoma horse racing\n\nindustry to the people of Oklahoma, the United States and abroad;\n\n7. To provide for the administration of the Oklahoma Breeding\n\nDevelopment Program. The Oklahoma Horse Racing Commission is hereby\n\nauthorized to utilize up to fifteen percent (15%) of the prior\n\nyear's receipts for administration. All expenses reimbursed as\n\nadministrative pursuant to this subsection shall be itemized and\n\naudited pursuant to subsection E of this section. Any monies\n\ntransferred from the Oklahoma Breeding Development Fund Special\n\nAccount to the Oklahoma Breeding Development Revolving Fund for\n\nadministrative reimbursement found to be unsubstantiated, excessive\n\nor ineligible for reimbursement by the audit shall be returned to\n\nthe Oklahoma Breeding Development Fund Special Account within thirty\nnd\n\naudited pursuant to subsection E of this section. Any monies\n\ntransferred from the Oklahoma Breeding Development Fund Special\n\nAccount to the Oklahoma Breeding Development Revolving Fund for\n\nadministrative reimbursement found to be unsubstantiated, excessive\n\nor ineligible for reimbursement by the audit shall be returned to\n\nthe Oklahoma Breeding Development Fund Special Account within thirty\n\n(30) days of the conclusion of the audit; and\n\n8. To provide, upon the request of an official horsemen's\n\nrepresentative organization for a breed, funding to any nonprofit\n\nentity that is based in Oklahoma and exempt from taxation pursuant\n\nto the provisions of the United States Internal Revenue Code, 26\n\nU.S.C. Section 501(c), for the purpose of providing care of retired\n\nand unwanted Oklahoma-bred racing stock of the particular breed of\n\nhorse represented by the requesting organization. Provided,\n\nhowever, that no monies shall be expended by the Commission for the\n\npurpose of this paragraph if federal funds are available for the\n\nsame purpose.\n\nC. By rule the Commission shall:\n\n1. Define the term \"Oklahoma-bred horse\";\n\n2. Qualify stallions for participation in Oklahoma-bred\n\nstallion awards;\n\n3. Provide for the registration of Oklahoma-domiciled mares and\n\nstallions and Oklahoma-bred horses. No such horse shall compete in\n\nthe races limited to Oklahoma-bred horses unless registered with the\n\nCommission. The Commission may prescribe such forms as are\n\nnecessary to determine the eligibility of such horses; provided,\n\nbreeding stallions shall be eligible for registration in the\n\nOklahoma-bred breeding program until July 1 of the breeding year.\n\nNo person shall knowingly prepare or cause preparation of an\n\napplication for registration of such foals which contains false\n\ninformation;\n\n4. Establish a schedule of fees for the registration of\n\nOklahoma-domiciled mares and stallions and Oklahoma-bred horses\n\nsufficient to provide for all expenses incurred in the\n\nadministration of the Oklahoma Breeding Development Fund Special\n\nAccount;\n\n5. Allow a mare registered as Oklahoma-bred racing stock which\n\nhas not been registered as an Oklahoma broodmare prior to foaling to\n\nbe registered as an Oklahoma broodmare upon payment of the\n\nregistration fee and a late fee not to exceed Two Hundred Dollars\n\n($200.00), which action shall entitle the foals of the mare to be\n\nregistered as Oklahoma-bred horses, provided all other\n\nqualifications of the Commission are met; and\n\n6. Establish criteria which a nonprofit entity based in\n\nOklahoma must meet to be eligible to receive funds for the purpose\n\nof caring for retired and unwanted Oklahoma-bred racing stock.\n\nD. The Commission may contract with and designate an official\n\nregistering agency to implement the registration of horses and the\n\npayment of awards from the Oklahoma Breeding Development Fund\n\nSpecial Account. The official registering agency shall operate\n\nunder the supervision of the Commission and be subject to the rules\n\nand regulations of the Commission. The official registering agency\n\nshall receive no compensation except fees received for registration\n\nof horses. In the event the Commission elects to perform as the\n\nofficial registering agency rather than contracting for such\n\nservices, the Commission shall deposit all registration fees from\n\nthe registration of Oklahoma-bred horses into the Oklahoma Breeding\n\nDevelopment Fund Special Account.","path":["OK Code","Title 3A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os3A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"137768664a76263622284278267fa053669d73a92afdfad0421db6ec2ded1336","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-3a-3a-208.2","next":"us-ok/okla.-stat.-tit.-3a-3a-208.3a"},"notice":"GroundRules: Original legal text.
