Stat. tit. 3A, § 3A-267","heading":"Official representatives of Thoroughbred and non-","body":"Thoroughbred horses - Negotiations and covenants - Financial\n\naccounting.\n\nFor purposes of this act, the organization elected by horsemen\n\nthat was, in 2003, providing representation for participating\n\nThoroughbred horsemen at meets restricted to Thoroughbred horses\n\nonly shall be the official representative of all Thoroughbreds\n\nparticipating in live race meets conducted by an organization\n\nlicensee. The organization elected by horsemen that was, in 2003,\n\nproviding representation for the breeds participating in mixed-breed\n\nracing shall be the official representative of all non-Thoroughbreds\n\nparticipating in live race meets conducted by an organization\n\nlicensee.\n\nOrganization licensees shall negotiate and covenant with the\n\nofficial representative for each breed participating at any race\n\nmeeting as to the conditions for each race meeting, the distribution\n\nof commissions and purses not governed by statutory distribution\n\nformulae, simulcast transmission, off-track wagering, all matters\n\nrelating to welfare, benefits and prerogatives of the participants\n\nin the meet, and any other matter required as a matter of law or\n\nnecessity. During race meets at which there is more than one\n\nofficial representative for horsemen, each official representative\n\nassociation shall designate an equal number of horsemen to serve on\n\na single committee that will periodically meet with the organization\n\nlicensee to discuss and facilitate track management operations. Any\n\nparticipating horsemen may with written notice filed with the\n\ntrack's horsemen's bookkeeper elect to opt out of representation by\n\nthe above-referenced organizations. In the event more than fifty\n\npercent (50%) of the total participating horsemen for a single breed\n\nopt to be excluded, the Oklahoma Horse Racing Commission may\n\ndetermine that an election be held among all participating horsemen\n\nof that breed to designate an alternate representative organization.\n\nThe official horsemen's representative organizations, and any\n\nbreed organizations receiving funding as a result of this act, shall\n\nprovide the Commission annually with a complete financial accounting\n\nfor the use of all funds received pursuant to this act. The\n\nofficial horsemen's representative organization shall administer the\n\nbenevolence program for participants in each live race meeting and a\n\ncomplete accounting of those funds along with the guidelines for\n\nadministration and determination of eligibility for the benevolence\n\nprogram are subject to approval by the Commission.","path":["OK Code","Title 3A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os3A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"9241d820e687cc727f80937e689bf9e08dcc58cdd731289e51a8519d85ea48f2","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-3a-3a-266","next":"us-ok/okla.-stat.-tit.-3a-3a-268"},"notice":"GroundRules: Original legal text.
