Stat. tit. 3A, § 3A-402","heading":"Definitions","body":"As used in the Oklahoma Charity Games Act, Section 401 et seq.\n\nof this title:\n\n1. \"Bingo\" means a game in which each player receives a bingo\n\nface and covers the squares according to the numbers, letters, or\n\ncombination of numbers and letters that have been announced by the\n\ncaller. The numbers and letters called are on an object selected at\n\nrandom either manually or mechanically from a receptacle in which\n\nhave been placed the objects bearing the numbers, letters, or\n\ncombinations of numbers and letters corresponding to the system used\n\nfor designating the bingo face squares. The winner of each bingo\n\ngame is the player who first properly covers a predetermined and\n\nannounced pattern of squares upon the bingo face being used by the\n\nplayer;\n\n2. \"Bingo face\" means a flat piece of paper which is marked off\n\ninto any number of squares in any arrangement of rows, with each\n\nsquare being designated by number, letter or combination of numbers\n\nand letters and with one or more squares designated as a \"free\"\n\nspace with the word \"Oklahoma\" and a facsimile outline of a map of\n\nOklahoma in it, which cannot be reused after the game in which a\n\nplayer has used it is over;\n\n3. \"Breakopen ticket card\" means a single folded or banded\n\nticket or a card, the face of which is initially covered or\n\notherwise hidden from view to conceal a number, letter, symbol, or\n\nset of letters or symbols, a few of which numbers, letters or\n\nsymbols out of every set of charity game tickets have been\n\ndesignated in advance at random as prize winners and which is used\n\nin a breakopen ticket game;\n\n4. \"Breakopen ticket game\" means a game wherein a player\n\nreceives a breakopen ticket card. A breakopen ticket game shall\n\nmeet the following criteria:\n\na. the game shall be assembled so that no placement of\n\nwinners or losers exists that allows the possibility\n\nof prize manipulation,\n\nb. the concealed numbers, letters, or symbols shall not\n\nbe visible from the outside of the game using high\n\nintensity lamps. Protection shall be provided by the\n\nopaque paper stock employed, with the possible\n\naddition of colors and printed blockout patterns or by\n\nuse of an aluminum foil laminate,\n\nc. a unique symbol or printed security device, such as a\n\nspecific number keyed to particular winners or the\n\nname of the symbol or some of the symbol colors\n\nchanged for a window, or other similar protection\n\nshall be placed in the winning windows of prize\n\nwindows to ensure that the winner image is unique,\n\nd. it shall not be possible to detect or pick out winning\n\nfrom losing tickets through variations in printing\n\ngraphics, color, or use of different printing plates,\n\ne. it shall not be possible to isolate winning or\n\npotential winning tickets from minor variations in\n\nsize or cutting of the tickets comprising a particular\n\npacket, and\n\nf. each ticket in a game shall have a serial number. All\n\ntickets in a game shall have the same serial number\n\nappearing in a conspicuous place on the ticket;\n\n5. \"Business entity\" means a person, company, corporation, or\n\npartnership organized for profit;\n\n6. \"Charity game\" means a bingo game, U-PIK-EM bingo game, or\n\nbreakopen ticket game conducted by an organization pursuant to the\n\nprovisions of the Oklahoma Charity Games Act;\n\n7. \"Charity game equipment\" means any object uniquely designed\n\nfor use in the conducting of a charity game including, but not\n\nlimited to, bingo faces, U-PIK-EM bingo game sets, and breakopen\n\nticket cards. Items used in conducting charity games which are not\n\ncharity game equipment are ink markers, furniture and general\n\nfurnishings of rooms where charity games are conducted;\n\n8. \"Commission\" or \"ABLE Commission\" means the Alcoholic\n\nBeverage Laws Enforcement Commission;\n\n9. \"Day session\" means the set time frame within which\n\nconducting of charity games is authorized beginning no earlier than\n\n10:00 a.m. and ending no later than 5:00 p.m.;\nch are not\n\ncharity game equipment are ink markers, furniture and general\n\nfurnishings of rooms where charity games are conducted;\n\n8. \"Commission\" or \"ABLE Commission\" means the Alcoholic\n\nBeverage Laws Enforcement Commission;\n\n9. \"Day session\" means the set time frame within which\n\nconducting of charity games is authorized beginning no earlier than\n\n10:00 a.m. and ending no later than 5:00 p.m.;\n\n10. \"Deal\" means one series of breakopen ticket game cards\n\nwhich has a stated number of winner payouts and a stated amount of\n\nthe payouts;\n\n11. \"Distributor\" means a person or business entity that sells,\n\nmarkets, or otherwise provides charity game equipment to an\n\norganization;\n\n12. \"Doing business\" means either conducting a charity game by\n\nan organization or providing goods or services to an organization by\n\na business entity;\n\n13. \"Employee\" means a person who works for compensation in a\n\nlicensed charity game establishment;\n\n14. \"Immediate family member\" means a spouse, parent, child or\n\nsibling or spouse of a parent, child or sibling of a resident of a\n\nfacility exempt from specific provisions of the Oklahoma Charity\n\nGames Act as provided in subsection C of Section 405 of this title;\n\n15. \"Licensee\" means any person, organization, or business\n\nentity which has received a license from the Commission;\n\n16. \"Location\" means the building, including the individual\n\nrooms and equipment in the rooms, grounds, and appurtenances,\n\nincluding adjacent premises if subject to the direct or indirect\n\ncontrol of the organization while conducting a charity game, which\n\nare used in connection with or in furtherance of the conducting of a\n\ncharity game;\n\n17. \"Manager\" means a person who:\n\na. is an employee of an organization,\n\nb. has supervisory authority over other employees or over\n\nthe conduct of charity games, and\n\nc. has been designated as such by the organization\n\npursuant to the provisions of subsection D of Section\n\n408 of this title;\n\n18. \"Manufacturer\" means a person or business entity that\n\nassembles from raw materials, supplies, or subparts to form a\n\ncompleted series of charity game equipment for use in charity games\n\nand that sells, markets, or otherwise provides such equipment to a\n\ndistributor;\n\n19. \"Night session\" means the set time frame within which\n\nconducting of charity games is authorized beginning no earlier than\n\n5:00 p.m. and ending no later than 12:00 p.m. midnight;\n\n20. \"Organization\" means a religious, charitable, labor,\n\nfraternal, educational, or other type of association or any branch,\n\nlodge, chapter, or auxiliary of such association which:\n\na. operates without profit to its members,\n\nb. has been in existence and been operating as a\n\nnonprofit organization for not less than two (2) years\n\nprior to applying for an organization license,\n\nc. is exempt from taxation pursuant to the provisions of\n\nparagraphs (3), (4), (5), (6), (7), (8), (9), (10), or\n\n(19) of subsection (c) of Section 501 or paragraph (1)\n\nof subsection (a) of Section 509 of the United States\n\nInternal Revenue Code of 1986, as amended, 26 U.S.C.,\n\nSection 501(c) et seq. or Section 509(a)(1), and\n\nd. formulates bylaws which clearly identify and\n\nestablish:\n\n(1) method of electing officers and their duties,\n\n(2) method by which members are elected, initiated or\n\nadmitted,\n\n(3) the rights and privileges of each member,\n\n(4) that each member has one vote, and\nction 509 of the United States\n\nInternal Revenue Code of 1986, as amended, 26 U.S.C.,\n\nSection 501(c) et seq. or Section 509(a)(1), and\n\nd. formulates bylaws which clearly identify and\n\nestablish:\n\n(1) method of electing officers and their duties,\n\n(2) method by which members are elected, initiated or\n\nadmitted,\n\n(3) the rights and privileges of each member,\n\n(4) that each member has one vote, and\n\n(5) that membership rights are personal to the member\n\nand not assignable;\n\n21. \"Progressive game\" means a game in which prizes are allowed\n\nto be carried over and increased from session to session;\n\n22. \"U-PIK-EM bingo game\" means a game played wherein a player\n\nwrites the numbers on a U-PIK-EM bingo game set. The player retains\n\none sheet of the set and deposits the second sheet in a receptacle\n\nin the control of the organization. The player then covers the\n\nnumbers as the caller announces a number. The numbers called are on\n\nan object selected at random either manually or mechanically from a\n\nreceptacle in which have been placed the objects bearing the\n\nnumbers. The winner of each U-PIK-EM bingo game is the player who\n\nfirst covers all the numbers appearing on the retained sheet in\n\naccordance with the pattern as designated on the sheet; and\n\n23. \"U-PIK-EM bingo game set\" means two paper sheets of\n\ncarbonless paper both bearing identical serial numbers on which a\n\nplayer writes numbers or letters, wherein one sheet is retained by\n\nthe player and used for playing and one sheet is held by the\n\norganization and used for verifying winners.","path":["OK Code","Title 3A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os3A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"054e99794576181534c9ea6a23c5fda377c8ce073de6701c2cff3e49b9b5e429","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-3a-3a-401","next":"us-ok/okla.-stat.-tit.-3a-3a-403"},"notice":"GroundRules: Original legal text.
