The ABLE Commission shall be the licensing authority for the\n\nlicensing of organizations, manufacturers, and distributors\n\nconducting, supplying, or otherwise providing charity games to the\n\npublic in this state.\n\nB. The Commission shall be responsible for the administration\n\nand enforcement of the Oklahoma Charity Games Act. In addition to\n\nsuch other duties as may be imposed on the Commission by law, and in\n\norder to perform that responsibility, the Commission shall:\n\n1. Adopt and promulgate rules for the purpose of administering\n\nand enforcing the Oklahoma Charity Games Act;\n\n2. Have the authority to issue, renew, suspend, or revoke any\n\nlicense authorized by the Oklahoma Charity Games Act;\n\n3. Conduct or direct the conducting of investigations relating\n\nto issuing, renewing, suspending, or revoking any license authorized\n\nby the Oklahoma Charity Games Act;\n\n4. Institute proceedings as the complainant against both\n\nlicensees and nonlicensees for violations of the Oklahoma Charity\n\nGames Act;\n\n5. Maintain records of all proceedings including minutes of\n\nmeetings, applications for licenses and related documents of\n\napplicants, and official documents filed in any hearings conducted\n\nby the Commission arising out of any provision of the Oklahoma\n\nCharity Games Act or the rules and regulations of the Commission.\n\nCopies of such records certified by the Director of the Commission\n\nshall be admissible as evidence in a civil or criminal action;\n\n6. Make such expenditures including employing such additional\n\nstaff as may be necessary for the administration and enforcement of\n\nthe Oklahoma Charity Games Act;\n\n7. Establish a standard recordkeeping system for the conduct of\n\ncharity games;\n\n8. Establish a model internal control system for use by\n\norganizations;\n\n9. Conduct all hearings including actions on investigations,\n\nissuance, denial, revocation, or suspension of a license, adoption\n\nof rules, and conduct meetings in accordance with the provisions of\n\nthe Administrative Procedures Act, Section 250 et seq. of Title 75\n\nof the Oklahoma Statutes, and the Oklahoma Open Meeting Act, Section\n\n301 et seq. of Title 25 of the Oklahoma Statutes; and\n\n10. Be responsible for approving locations for the conducting\n\nof charity games.\n\nC. The members of the Commission, the Director and such agents\n\nas the Commission appoints shall have all the powers and authority\n\nof peace officers of this state for purposes of enforcing the\n\nprovisions of the Oklahoma Charity Games Act.\n\nD. The Commission shall have the authority to regularly inspect\n\nall locations or places of business of licensees and all other\n\npersons, firms or corporations dealing in the manufacture,\n\ndistribution, transportation, sale or service of charity games or\n\ncharity game equipment within this state. Any officer or employee\n\nof the Commission with responsibility for enforcement of the\n\nOklahoma Charity Games Act shall have the power and authority,\n\nwithout a warrant, to enter and examine the location or place of\n\nbusiness of any licensee, during normal operating hours thereof, to\n\ndetermine if any violation of the provisions of the Oklahoma Charity\n\nGames Act or rules of the Commission is or may be occurring. The\n\nright of entry and inspection shall be a condition upon which every\n\nlicense shall be issued and the application for and acceptance of\n\nany license hereunder shall conclusively be deemed to be consent of\n\nthe applicant and licensee to such entry and inspection. Officers\n\nand employees of the Commission or the Oklahoma Tax Commission shall\n\nbe given free access to and shall not be hindered or interfered with\n\nin their examination of the location or place of business of any\n\nlicensee, and in any case in which such officer or employee is\n\ndenied free access and entry or is hindered or interfered with in\ne applicant and licensee to such entry and inspection.
