Stat. tit. 3A, § 3A-717","heading":"Statewide network of lottery retailers – Compensation –","body":"Criteria for qualification.\n\nA. The people of this state recognize that to conduct a\n\nsuccessful lottery, the Oklahoma Lottery Commission must develop and\n\nmaintain a statewide network of lottery retailers that will serve\n\nthe public convenience and promote the sale of tickets or shares and\n\nthe playing of lottery games while ensuring the integrity of the\n\nlottery operations, games, and activities.\n\nB. The Commission shall make every effort to provide small\n\nretailers a chance to participate in the sales of lottery tickets or\n\nshares.\n\nC. The Commission shall provide for compensation to lottery\n\nretailers in the form of commissions in an amount of not less than\n\ntwo percent (2%) of gross sales and may provide for other forms of\n\ncompensation for services rendered in the sale or cashing of lottery\n\ntickets or shares.\n\nD. The Commission shall issue a certificate of authority to\n\neach person with whom it contracts as a retailer for purposes of\n\ndisplay for each location at which tickets or shares are offered for\n\nsale. Every lottery retailer shall post and keep conspicuously\n\ndisplayed in a location on the premises accessible to the public its\n\ncertificate of authority. No certificate of authority shall be\n\nassignable or transferable.\n\nE. The board of trustees of the Oklahoma Lottery Commission\n\nshall develop a list of objective criteria upon which the\n\nqualification of lottery retailers shall be based. Separate\n\ncriteria shall be developed to govern the selection of retailers of\n\ninstant tickets. In developing these criteria, the board shall\n\nconsider such factors as the financial responsibility of the\n\napplicant, security of the place of business or activity of the\n\napplicant, accessibility to the public, integrity, and reputation.\n\nThe board shall not consider political affiliation, activities, or\n\ncontributions to political committees or candidates for any public\n\noffice. The criteria shall include, but not be limited to, the\n\nfollowing:\n\n1. The applicant shall be current in filing all applicable tax\n\nreturns to the State of Oklahoma and in payment of all taxes,\n\ninterest, and penalties owed to the State of Oklahoma, excluding\n\nitems under formal appeal pursuant to applicable statutes. An\n\napplicant who has entered into and is abiding by a payment agreement\n\nwith the Oklahoma Tax Commission shall be deemed current in payment\n\nof such taxes, penalties and interest. Notwithstanding the\n\nprovisions of Section 205 of Title 68 of the Oklahoma Statutes, the\n\nOklahoma Tax Commission shall provide this information to the\n\nCommission;\n\n2. No person, partnership, unincorporated association,\n\ncorporation, or other business entity or principal, officer or\n\ndirector of a corporation or other business entity shall be selected\n\nas a lottery retailer who:\n\na. has been convicted of or is awaiting sentencing on a\n\nplea of guilt or nolo contendere to a criminal offense\n\nrelated to the security or integrity of the lottery in\n\nthis or any other jurisdiction,\n\nb. has been convicted of or is awaiting sentencing on a\n\nplea of guilt or nolo contendere to any illegal\n\ngambling activity, false statements, false swearing,\n\nor perjury in this or any other jurisdiction or\n\nconvicted of or is awaiting sentencing on a plea of\n\nguilt or nolo contendere to any crime punishable by\n\nmore than one (1) year of imprisonment or a fine of\n\nmore than One Thousand Dollars ($1,000.00) or both,\n\nunless the civil rights of the person have been\n\nrestored and at least five (5) years have elapsed from\n\nthe date of the completion of the sentence without a\n\nsubsequent conviction of a crime described in this\n\nsubparagraph,\n\nc. has been found to have violated the provisions of the\n\nOklahoma Education Lottery Act or any rule, policy, or\n\nprocedure of the Commission unless either ten (10)\n\nyears have passed since the violation or the board\nbeen\n\nrestored and at least five (5) years have elapsed from\n\nthe date of the completion of the sentence without a\n\nsubsequent conviction of a crime described in this\n\nsubparagraph,\n\nc. has been found to have violated the provisions of the\n\nOklahoma Education Lottery Act or any rule, policy, or\n\nprocedure of the Commission unless either ten (10)\n\nyears have passed since the violation or the board\n\nfinds the violation both minor and unintentional in\n\nnature,\n\nd. is a vendor or any employee or agent of any vendor\n\ndoing business with the Commission,\n\ne. resides in the same household as the executive\n\ndirector, any board member, or any employee of the\n\nCommission,\n\nf. has made a statement of material fact to the\n\nCommission knowing such statement to be false, or\n\ng. is engaged exclusively in the business of selling\n\nlottery tickets or shares. This subparagraph shall\n\nnot preclude the Commission from selling or giving\n\naway lottery tickets or shares for promotional\n\npurposes;\n\n3. Persons applying to become lottery retailers shall be\n\ncharged a uniform application fee for each lottery outlet;\n\n4. Any lottery retailer contract executed pursuant to this\n\nsection may, for good cause, be suspended, revoked, or terminated by\n\nthe executive director or designee if the retailer is found to have\n\nviolated any provisions of the Oklahoma Education Lottery Act or\n\nobjective criteria established by the board. Review of such\n\nactivities shall be in accordance with the procedures outlined in\n\nthe Oklahoma Education Lottery Act and shall not be subject to the\n\nAdministrative Procedures Act; and\n\n5. All lottery retailer contracts may be renewable annually in\n\nthe discretion of the Commission unless sooner canceled or\n\nterminated.\n\nF. No certificate of authority to act as a lottery retailer\n\nshall be issued to any applicant doing business or who holds a\n\nlicense to do business as a pawnbroker, supervised lender, or\n\ndeferred deposit lender, also known as a payday lender, or whose\n\nprimary business is categorized as a check casher.\n\nG.
