Any retailer, vendor, or applicant for a retailer or vendor\n\ncontract aggrieved by an action of the board of trustees of the\n\nOklahoma Lottery Commission may appeal that decision to the district\n\ncourt of Oklahoma County.\n\nB. The district court of Oklahoma County shall hear appeals\n\nfrom decisions of the board and based upon the record of the\n\nproceedings before the board may reverse the decision of the board\n\nonly if the appellant proves the decision to be:\n\n1. Clearly erroneous;\n\n2. Arbitrary and capricious;\n\n3. Procured by fraud;\n\n4. A result of substantial misconduct by the board; or\n\n5. Contrary to the United States Constitution or the Oklahoma\n\nConstitution or the provisions of the Oklahoma Education Lottery\n\nAct.\n\nC. The court may remand an appeal to the board to conduct\n\nfurther hearings.\n\nD. Any person who appeals the award of a major procurement\n\ncontract for the supply of a lottery ticket system, share system, or\n\nan on-line or other mechanical or electronic system shall be liable\n\nfor all costs of appeal and defense in the event the appeal is\n\ndenied or the contract award upheld.
