As used in this section:\n\n1. \"Cattle crossing signage\" means a sign in a twenty-four (24)\n\ninch diamond shape that depicts a black cow graphic on a yellow\n\nbackground; and\n\n2. \"Open pasture road\" means a road maintained by a county;\n\nland on both sides of the road is owned by the same owner; and a\n\nroadway without fencing.\n\nB. Any public road, as defined in Section 232 of Title 69 of\n\nthe Oklahoma Statutes, in whole or in part, that is maintained by a\n\ncounty and that meets the following conditions by November 1, 2025,\n\nshall be designated as an open pasture road:\n\n1. Cattle guards have been installed at the access points of\n\nsuch road or part thereof;\n\n2. The land on either side of the road or part thereof to be\n\ndesignated is owned by a single party; and\n\n3. There is no fencing erected on such land on either side of\n\nthe road.\n\nIt shall be the responsibility of the property owner to notify\n\nthe board of county commissioners that the roadway is eligible to be\n\ndesignated as an open pasture road. Such notification shall state\n\nthe proposed action and clearly show on a map the location and\n\nterminals of the road. The map shall also demonstrate that the\n\nproperty where the road is located belongs to the property owner\n\nrequesting such designation.\n\nC. The board of county commissioners shall cause the erection\n\nof cattle crossing signage at the terminals of the open pasture\n\nroad. The cost associated with such signage shall be provided by\n\nthe property owner requesting such designation.\n\nD. Neither the property owner nor the owner of livestock that\n\nare on property where an open pasture road is located shall be\n\nliable for damages to any motor vehicle or occupants thereof caused\n\nby collision with livestock on a designated open pasture road.\n\nE. Only a public road meeting the requirements of subsection B\n\nof this section on November 1, 2025, may be designated as an open\n\npasture road. After such date, even if conditions on a property\n\nchange to meet the requirements of subsection B of this section,\n\nsuch property may not be designated as an open pasture road.\n\nF. Once annually, the owner of a property where an open pasture\n\nroad is located shall provide notice to the board of county\n\ncommissioners demonstrating that the property continues to meet the\n\nrequirements of subsection B of this section. Such notice shall\n\nalso include an indication that the property owner desires such\n\ndesignation to continue. If such property owner indicates that they\n\nno longer desire for such designation to continue, or if the notice\n\ndemonstrates that the property no longer meets any of the conditions\n\nrequired by subsection B of this section, the road shall lose the\n\ndesignation and the owner of such property shall have thirty (30)\n\ndays after the board of county commissioners receives such notice to\n\nensure any livestock on the property are fenced out of the roadway.","path":["OK Code","Title 4"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os4.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"edf7b6f3547514462e6a5f15056b7bf3fdc2c6ff84bd8777a72099772617590a","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-49-49-7","next":"us-ok/okla.-stat.-tit.-4-4-132"},"notice":"GroundRules: Original legal text.
