Stat. tit. 4, § 4-201.2","heading":"Definitions","body":"As used in the Livestock Owner’s Lien Act of 2011:\n\n1. “Affiliate” means any person who is controlled, directly or\n\nindirectly, by a first purchaser, or who controls, directly or\n\nindirectly, a first purchaser. \"Control\" or \"controlled by\" means\n\nthe possession, directly or indirectly, of the power to direct or\n\ncause the direction of the management and policies of a person,\n\nwhether through ownership, by contract, or otherwise;\n\n2. \"Agreement to sell\" means any enforceable agreement, whether\n\noral or written, by which a livestock owner, either directly or\n\nthrough a sales agent, agrees to sell livestock to a first\n\npurchaser;\n\n3. \"Article 9\" means Article 9 of the Oklahoma Uniform\n\nCommercial Code in effect as of the relevant date or a comparable\n\narticle under the uniform commercial code of another state to the\n\nextent applicable;\n\n4. \"First purchaser\" means the first person that purchases\n\nlivestock, either directly or through a sales agent, under an\n\nagreement to sell;\n\n5. “Livestock” means cattle, bison, horses, sheep, goats,\n\nasses, mules, swine, domesticated rabbits, chickens, turkeys, or any\n\ndomesticated animal raised primarily for human food consumption;\n\n6. \"Livestock owner\" means a person owning an interest in\n\nlivestock before the acquisition thereof by a first purchaser;\n\n7. “Owner’s lender” means a person that has a valid mortgage\n\nlien or security interest in a livestock owner’s livestock at the\n\ntime of delivery of such Livestock to the first purchaser;\n\n8. \"Owner’s lien\" means the lien granted by this act;\n\n9. \"Permitted lien\" means any of the following liens or\n\nsecurity interests:\n\na. a mortgage lien or security interest granted by a\n\nfirst purchaser which secures payment under a written\n\ninstrument of indebtedness signed by the first\n\npurchaser and accepted in writing by the payee thereof\n\nprior to the effective date of this act with a\n\nprincipal amount and a fixed maturity stated therein;\n\nprovided, however, a permitted lien does not include a\n\nmortgage lien or security interest which:\n\n(1) secures payment of any indebtedness incurred\n\nafter the effective date of this act,\n\n(2) secures payment under a written instrument of\n\nindebtedness not signed by a first purchaser and\n\naccepted in writing by the payee thereof prior to\n\nthe effective date of this act,\n\n(3) secures payment under a written instrument of\n\nindebtedness modified, amended or restated from\n\nor after the effective date of this act which\n\nmodification, amendment or restatement increases\n\nthe principal amount which was owing at the\n\neffective date of this act,\n\n(4) secures payment under a written instrument of\n\nindebtedness modified, amended or restated from\n\nor after the effective date of this act which\n\nmodification, amendment or restatement extends\n\nthe stated maturity thereof which was in effect\n\nat the effective date of this act, or\nication, amendment or restatement increases\n\nthe principal amount which was owing at the\n\neffective date of this act,\n\n(4) secures payment under a written instrument of\n\nindebtedness modified, amended or restated from\n\nor after the effective date of this act which\n\nmodification, amendment or restatement extends\n\nthe stated maturity thereof which was in effect\n\nat the effective date of this act, or\n\n(5) is not validly perfected with a first priority\n\nagainst the claims of all persons under\n\napplicable law other than persons holding a\n\nstatutory or regulatory lien as to which first\n\npriority is granted by statute or regulation, or\n\nb. a validly perfected and enforceable lien created by\n\nstatute in relation to livestock purchased under an\n\nagreement to sell which secures payment of any\n\nindebtedness incurred by the first purchaser prior to\n\nthe effective date of this act;\n\n10. \"Person\" means any individual, executor, administrator,\n\nestate, agent, trust, trustee, institution, receiver, business\n\ntrust, firm, business entity, corporation, partnership, limited\n\nliability company, cooperative, joint venture, governmental entity\n\nor agency, association or any other group or combination acting as a\n\nunit;\n\n11. \"Proceeds\" means:\n\na. any right or amount paid or to be paid in\n\nconsideration of, or as a consequence of, the sale of\n\nlivestock such as cash proceeds, accounts, chattel\n\npaper, instruments, or payment intangibles, or\n\nb. any by-products from the slaughter of livestock, or\n\nany right or amount paid or to be paid in\n\nconsideration of, or as a consequence of, the sale of\n\nsuch by-products;\n\n12. \"Purchaser\" means a person who is not an affiliate of a\n\nfirst purchaser and who takes, receives or purchases livestock from\n\na first purchaser;\n\n13. \"Sales agent\" means any person who is authorized, including,\n\nwithout limitation, a livestock auction, auctioneer, commission\n\ncompany, or broker, to sell livestock on behalf of, or for the\n\nbenefit of, another person; and\n\n14. \"Sales price\" means the amount a first purchaser agrees to\n\npay a livestock owner or sales agent under an agreement to sell.","path":["OK
