After notice and opportunity for a hearing in accordance\n\nwith the Administrative Procedures Act, if the State Board of\n\nAgriculture finds any person in violation of the Commercial Pet\n\nBreeders and Animal Shelter Licensing Act or any rule promulgated or\n\norder issued pursuant thereto, the Board shall have the authority to\n\nassess an administrative penalty of not less than One Hundred\n\nDollars ($100.00) and not more than Ten Thousand Dollars\n\n($10,000.00) for each violation. Each animal, each action, or each\n\nday a violation continues may constitute a separate and distinct\n\nviolation. During each license year of the facility, a facility\n\nshall not be subject to more than Ten Thousand Dollars ($10,000.00)\n\nin administrative penalties assessed pursuant to this subsection.\n\nB. A person commits an offense if the person violates the\n\nCommercial Pet Breeders and Animal Shelter Licensing Act or any rule\n\nadopted under the Commercial Pet Breeders and Animal Shelter\n\nLicensing Act. Each animal to which a violation applies and each\n\nday that violation continues constitutes a separate offense. An\n\noffense under this subsection is a misdemeanor punishable as\n\nprovided in subsection F of this section.\n\nC. A person commits an offense if the person knowingly\n\nfalsifies information in a license application, annual report, or\n\nrecord required under the Commercial Pet Breeders and Animal Shelter\n\nLicensing Act. An offense under this subsection is a misdemeanor\n\npunishable as provided in subsection F of this section.\n\nD. An unlicensed commercial pet breeder commits an offense if\n\nthe breeder advertises animals for sale. An offense under this\n\nsubsection is a misdemeanor punishable as provided in subsection F\n\nof this section.\n\nE. An animal shelter or commercial pet breeder commits an\n\noffense if the animal shelter or commercial breeder interferes with,\n\nhinders, or thwarts any inspection or investigation under the\n\nCommercial Pet Breeders and Animal Shelter Licensing Act or refuses\n\nto allow an inspector full access to all areas of the facility where\n\nanimals are kept or cared for and all records required to be kept\n\nunder the Commercial Pet Breeders and Animal Shelter Licensing Act\n\nor any rule adopted under the Commercial Pet Breeders and Animal\n\nShelter Licensing Act. An offense under this subsection is a\n\nmisdemeanor punishable as provided in subsection F of this section.\n\nF. 1. Any violation of subsection B, C or D of this section\n\nshall be punishable by a fine not to exceed Five Hundred Dollars\n\n($500.00).\n\n2. Any violation of subsection E of this section shall be\n\npunishable by a fine not to exceed One Thousand Dollars ($1,000.00).\n\nG. In addition to penalties and fines, the Board shall have\n\nauthority to obtain injunctions against anyone who violates the\n\nCommercial Pet Breeders and Animal Shelter Licensing Act, and shall\n\nhave authority to obtain or impose civil monetary penalties on\n\nanyone who violates the Commercial Pet Breeders and Animal Shelter\n\nLicensing Act, and upon obtaining a court order, shall have\n\nauthority to seize and impound animals in the possession, custody,\n\nor care of that person if there is reason to believe that the\n\nhealth, safety, or welfare of the animals is endangered, or the\n\nanimals are in imminent danger. The reasonable costs of\n\ntransportation, care, and feeding of seized and impounded animals\n\nshall be paid by the person from whom the dogs or cats were seized\n\nand impounded.\n\nH. Nothing in the Commercial Pet Breeders and Animal Shelter\n\nLicensing Act shall preclude the Board from seeking penalties in\n\ndistrict court in the maximum amount allowed by law. The assessment\n\nof penalties in an administrative enforcement proceeding shall not\n\nprevent the subsequent assessment by a court of the maximum civil or\n\ncriminal penalties for violations of the Commercial Pet Breeders and\n\nAnimal Shelter Licensing Act and rules promulgated pursuant thereto.\nct shall preclude the Board from seeking penalties in\n\ndistrict court in the maximum amount allowed by law. The assessment\n\nof penalties in an administrative enforcement proceeding shall not\n\nprevent the subsequent assessment by a court of the maximum civil or\n\ncriminal penalties for violations of the Commercial Pet Breeders and\n\nAnimal Shelter Licensing Act and rules promulgated pursuant thereto.\n\nI. Any person assessed an administrative or civil penalty may\n\nbe required to pay, in addition to the penalty amount and interest\n\nthereon, attorney fees and costs associated with the collection of\n\nthe penalties.\n\nJ.
