Stat. tit. 4, § 4-42.4","heading":"Owners of dangerous dogs, bite or attacks on public","body":"property - Penalty.\n\nA. It is unlawful for the owner of any dog that previously has:\n\n1. When unprovoked inflicted bites on any person or severely\n\ninjured any person either on public or private property; or\n\n2. When unprovoked created an imminent threat of injury or\n\ndeath to any person,\n\nto permit such dog to run at large or aggressively bite or attack\n\nany person while such person is lawfully upon public or private\n\nproperty. Upon conviction, the violator shall be guilty of a\n\nmisdemeanor punishable by imprisonment in the county jail for not\n\nmore than one (1) year, or by imposition of a fine not to exceed\n\nFive Thousand Dollars ($5,000.00), or by both such fine and\n\nimprisonment. In addition, the owner shall be liable for damages as\n\nprovided in Section 42.1 of this title.\n\nB. The owner of any dangerous dog as defined by Section 44 of\n\nthis title, or any dog that is described in subsection A of this\n\nsection, that attacks any person causing the death of such person\n\nshall, upon conviction, be guilty of a Class D1 felony offense\n\npunishable by imprisonment as provided for in subsections B through\n\nF of Section 20N of Title 21 of the Oklahoma Statutes, or by the\n\nimposition of a fine not to exceed Twenty-five Thousand Dollars\n\n($25,000.00), or by both such fine and imprisonment.\n\nC. It is unlawful for any person to release any dog upon a law\n\nenforcement officer while the officer is in the performance of\n\nofficial duties. Upon conviction, the violator shall be guilty of a\n\nClass D1 felony offense punishable by imprisonment as provided for\n\nin subsections B through F of Section 20N of Title 21 of the\n\nOklahoma Statutes, or by imposition of a fine not exceeding Five\n\nThousand Dollars ($5,000.00), or by both such fine and imprisonment.\n\nD.
