Stat. tit. 4, § 4-801","heading":"Public accommodations – Policy to prohibit animals –","body":"Service animal exception.\n\nA. For purposes of this section:\n\n1. The terms \"place of public accommodation\", \"public\n\naccommodation\" and \"service animal\" shall have the same meaning as\n\nsuch terms are defined in 28 C.F.R., Section 36.104. \"Service\n\nanimal\" does not include an emotional support animal or a therapy\n\nanimal;\n\n2. \"Emotional support animal\" means an animal selected to\n\nreside with an individual with a disability that does not work or\n\nperform tasks for the benefit of an individual with a disability and\n\ndoes not accompany at all times an individual with a disability; and\n\n3. \"Therapy animal\" means a personal pet who is certified to\n\nmake therapeutic visits with a trained volunteer to places\n\nincluding, but not limited to, nursing facilities, schools and\n\nhospitals to bring therapeutic benefit, comfort and cheer to others.\n\nB. A public accommodation may adopt a policy to prohibit\n\nanimals, except service animals, from entering the place of public\n\naccommodation.\n\nC. A public accommodation which adopts such a policy shall post\n\na sign in a conspicuous location outside the entrance of the place\n\nof public accommodation stating which animals or types of animals\n\nare prohibited. Such sign shall also state that service animals are\n\npermitted.\n\nD. If a public accommodation inquires into the qualification of\n\na service animal, the public accommodation shall comply with 28\n\nC.F.R., Section 36.302(c)(6).\n\nE. Any person who is not an individual with a disability or is\n\nnot trained to assist individuals with disabilities, who uses a\n\nservice animal in an attempt to gain treatment or benefits as an\n\nindividual with a disability shall, upon conviction, be guilty of a\n\nmisdemeanor.\n\nF.
