Upon receiving notice of the taking up of any strayed\n\nanimal, it shall be the duty of any peace officer, unless the owner\n\nthereof is identified and known by the peace officer to be the\n\nowner, to make or cause to be made an examination of the brand\n\nrecords and reports of lost, strayed and stolen livestock.\n\n2. If from these records the name of the owner or probable\n\nowner can be determined, the owner shall be notified forthwith of\n\nthe taking up of the strayed animal.\n\n3. If the name of the owner or probable owner cannot be\n\ndetermined, the officer shall arrange for the housing of the animal\n\nas provided by subsection B of this section.\n\nB. The Department of Public Safety and any municipality,\n\ncounty, or other political subdivision of this state may establish a\n\nlist of facilities, including, but not limited to, livestock sales\n\nfacilities or veterinary clinics, for an official rotation log for\n\nthe keeping of strayed animals pursuant to the request of or at the\n\ndirection of any officer of the Department or a municipality,\n\ncounty, or other political subdivision. The Department of Public\n\nSafety may promulgate rules for the implementation and\n\nadministration of this section.\n\nC. Upon the owner's proving to the satisfaction of the peace\n\nofficer that the animal is lawfully the owner's, the peace officer\n\nshall allow the animal to be taken by the owner, upon payment of the\n\nactual cost for keeping it together with the amount of any damages\n\nsuffered by the taker-up as a result of the strayed animal being\n\nupon the premises of the taker-up.\n\nD. If the owner fails to pay the charges, the animal shall be\n\nsold according to provisions of Section 85.6 of this title.\n\nE.
