Stat. tit. 40, § 40-1-209","heading":"Employing unit","body":"EMPLOYING UNIT.\n\nAll individuals performing services within this state for any\n\nemploying unit which maintains two or more separate establishments\n\nwithin this state shall be deemed to be employed by a single\n\nemploying unit for all the purposes of the Employment Security Act\n\nof 1980, except as provided under paragraphs 10 and 11 of Section 1-\n\n208 of this title.\n\nWhenever any employing unit contracts with or has under it any\n\ncontractor or subcontractor for any employment, which is part of its\n\nusual trade, occupation, profession, or business, unless the\n\nemploying unit as well as each such contractor or subcontractor is\n\nan employer by reason of Section 1-208 or Section 3-203 of this\n\ntitle, the employing unit shall for all the purposes of the\n\nEmployment Security Act of 1980 be deemed to employ each individual\n\nin the employ of each such contractor or subcontractor for each day\n\nduring which such individual is engaged in performing such\n\nemployment; except that each such contractor or subcontractor who is\n\nan employer by reason of Section 1-208 or Section 3-203 of this\n\ntitle shall alone be liable for the contributions measured by wages\n\npaid to individuals employed by the contractor or subcontractor, and\n\nexcept that any employing unit which shall become liable for and pay\n\ncontributions with respect to individuals in the employ of any such\n\ncontractor or subcontractor who is not an employer by reason of\n\nSection 1-208 or Section 3-203 of this title may recover the same\n\nfrom such contractor or subcontractor.\n\nEach individual employed to perform or to assist in performing\n\nthe work of any agent or employee of an employing unit shall be\n\ndeemed to be employed by such employing unit for all the purposes of\n\nthe Employment Security Act of 1980, whether such individual was\n\nhired or paid directly by such employing unit or by such agent or\n\nemployee of an employing unit, provided the employing unit had\n\nactual or constructive knowledge of the employment.","path":["OK Code","Title 40"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os40.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"bcfbe87fa319d798b9990293057aef17d3b5616262c85b3087f3d77f54b1723c","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-40-40-1-208a","next":"us-ok/okla.-stat.-tit.-40-40-1-209.1"},"notice":"GroundRules: Original legal text.
