An individual shall be deemed unemployed with\n\nrespect to any week during which:\n\n1. The individual performed no services; and\n\n2. No wages are payable to the individual.\n\nB. For an initial or additional initial claim filing, an\n\nindividual shall be deemed unemployed:\n\n1. With respect to any week of less than full-time work, if the\n\nwages payable to the individual are less than his or her weekly\n\nbenefit amount plus One Hundred Dollars ($100.00); and\n\n2. If the individual has incurred a loss of wages or reductions\n\nin hours equal to or greater than fifteen percent (15%) of the\n\nincome or hours worked, based on his or her customary work\n\nexperience or contract of hire.\n\nC. For filing made during a continued claim series, an\n\nindividual shall be deemed unemployed with respect to any week of\n\nless than full-time work if the wages payable to the individual are\n\nless than his or her weekly benefit amount plus One Hundred Dollars\n\n($100.00).\n\nD. For the purpose of this section only, any vacation leave\n\npayments or sick leave payments, which such individual may receive\n\nor be entitled to from his or her employer or former employer,\n\narising by reason of separation from employment, shall be deemed not\n\nto be wages as the term wages is used in this section.\n\nE.
