The Commissioner of Labor or the chief boiler inspector, or\n\nany deputy inspector, shall have free access, during reasonable\n\nhours, to any premises in the state where a boiler or pressure\n\nvessel is being constructed for use in, or is being installed in\n\nthis state for the purpose of ascertaining whether such boiler or\n\npressure vessel is being constructed and installed in accordance\n\nwith the provisions of the Boiler and Pressure Vessel Safety Act.\n\nB. Each boiler and pressure vessel covered by the Boiler and\n\nPressure Vessel Safety Act shall be thoroughly inspected as to its\n\nconstruction, installation and condition as follows:\n\n1. Power boilers and high pressure high temperature water\n\nboilers shall receive an inspection annually which shall be an\n\ninternal inspection where construction permits; otherwise it shall\n\nbe as complete an inspection as possible. Such boilers shall also\n\nbe externally inspected annually preferably while under pressure;\n\n2. Low pressure steam or vapor heating boilers shall receive an\n\nexternal inspection annually with an internal inspection at least\n\nevery two (2) years where construction permits;\n\n3. Hot water heating and hot water supply boilers shall receive\n\nan external inspection annually with an internal inspection at the\n\ndiscretion of the inspector;\n\n4. Hot water supply heaters shall receive a certificate\n\ninspection annually, if possible, but biennially as a minimum;\n\n5. Pressure vessels, excluding those within the scope of the\n\nAmerican Petroleum Institute Pressure Vessel Inspection Code,\n\nsubject to internal corrosion and waste heat steam generators shall\n\nreceive an internal inspection triennially where construction\n\npermits. Pressure vessels not subject to internal corrosion shall\n\nreceive an inspection at intervals set by the Commissioner.\n\nFrequency of external inspections of pressure vessels shall be set\n\nby the Commissioner;\n\n6. A grace period of two (2) months beyond the periods\n\nspecified in paragraphs 1, 2, 3, 4 and 5 of this subsection is\n\npermitted between inspections; however, the inspection due date\n\nshall not be affected; provided, however, for an entity with two or\n\nmore boilers or pressure vessels, the Commissioner may allow all\n\ninspections of the boilers or pressure vessels to be conducted at\n\nthat location at the same time;\n\n7. The Commissioner of Labor may provide for longer periods\n\nbetween inspections in the rules for specific boilers and pressure\n\nvessels; and\n\n8. Under the provisions of the Boiler and Pressure Vessel\n\nSafety Act, the Commissioner of Labor is responsible to provide\n\nrules for the safety of life, limb and property and therefore has\n\njurisdiction over the interpretation and application of the\n\ninspection requirements as provided for in the rules. Inspection\n\nduring construction and installation shall certify as to the minimum\n\nrequirement for safety as defined in the American Society of\n\nMechanical Engineers Code or other construction standards acceptable\n\nto the Commissioner of Labor. Inspection requirements of operating\n\nequipment shall be in accordance with generally accepted practice\n\nand compatible with the actual service condition, such as:\n\na. previous experience, based on records of inspection,\n\nperformance and maintenance,\n\nb. location, with respect to personnel hazard,\n\nc. quality of inspection and operating personnel,\n\nd. provision for related safe operating controls, and\n\ne. interrelation with other operations outside the scope\n\nof the Boiler and Pressure Vessel Safety Act.\n\nBased upon the documentation of such actual service conditions\n\nby the owner or user of the operating equipment, the Commissioner of\n\nLabor may, at his discretion, permit variations in the inspection\n\nrequirements.\n\nC. The inspections herein required shall be made by the\n\nCommissioner, chief boiler inspector, deputy inspector or a special\nSafety Act.\n\nBased upon the documentation of such actual service conditions\n\nby the owner or user of the operating equipment, the Commissioner of\n\nLabor may, at his discretion, permit variations in the inspection\n\nrequirements.\n\nC. The inspections herein required shall be made by the\n\nCommissioner, chief boiler inspector, deputy inspector or a special\n\ninspector as provided for in the Boiler and Pressure Vessel Safety\n\nAct except that hot water supply heaters may be inspected by state-\n\nlicensed boiler operators or state-licensed plumbers or plumbing\n\ncontractors. The Commissioner of Labor may designate by rule the\n\nhot water supply heaters, by design type, that are not subject to\n\ninspection.\n\nD. Owner-user inspection of boilers and pressure vessels is\n\npermitted provided the owner-user inspection service is regularly\n\nestablished and is under the supervision of one or more individuals\n\nwhose qualifications are satisfactory to the Commissioner of Labor\n\nand the owner-user causes the pressure vessels to be inspected in\n\nconformance with the National Board Inspection Code or American\n\nPetroleum Institute Pressure Vessel Inspection Code as applicable.\n\nE. If, at the discretion of the inspector, a hydrostatic test\n\nshall be deemed necessary, it shall be made by the owner or user or\n\nhis licensed representative and witnessed by an inspector as\n\nauthorized by the Boiler and Pressure Vessel Safety Act, before a\n\ncertificate of operation is issued.\n\nF. All boilers, other than cast iron sectional boilers, and\n\npressure vessels to be installed in this state after the twelve-\n\nmonth period from the date upon which the rules of the Commissioner\n\nbecome effective, shall be inspected during construction as required\n\nby the applicable rules by an inspector authorized to inspect\n\nboilers and pressure vessels in this state, or if constructed\n\noutside of the state, by an inspector holding a valid commission\n\nissued by the National Board of Boiler and Pressure Vessel\n\nInspectors.\n\nG.
