Formulation. The Commissioner of Labor shall formulate and\n\nadopt definitions, rules and regulations for the safe construction,\n\ninstallation, inspection, operation, maintenance and repair of\n\nboilers and pressure vessels in this state.\n\n1. The definitions, rules and regulations so formulated for new\n\nconstruction shall be based upon and follow generally accepted\n\nnational engineering standards, formula and practices related to\n\nboiler and pressure vessel construction and safety. The\n\nCommissioner of Labor may adopt an existing American National\n\nStandard known as the Boiler and Pressure Code of the American\n\nSociety of Mechanical Engineers, with the addenda and code cases,\n\nand may also adopt subsequent revisions in the form of addenda and\n\ncode cases of that standard provided such revisions are acceptable\n\nto the Commissioner. When so adopted, the same shall be deemed\n\nincorporated into, and to constitute a part of the whole of the\n\ndefinitions, rules and regulations of the Commissioner of Labor;\n\n2. The Commissioner of Labor shall formulate rules and\n\nregulations to ensure that boiler and pressure vessel manufacturers,\n\njobbers, dealers or individuals selling, renting or leasing or\n\noffering for sale, rent or lease or operation, any boiler or\n\npressure vessel which is within the scope of this act meets the\n\nrequirements of this act, rules and regulations hereinafter adopted.\n\nAny manufacturer, jobber, dealer or individual found to be in\n\nviolation of this section shall be subject to any current penalty as\n\nherein provided;\n\n3. The Commissioner of Labor shall formulate rules and\n\nregulations which may permit the use of boilers and pressure vessels\n\nwhich were in operation in this state prior to the date upon which\n\nthe first rules and regulations under this act pertaining to\n\nexisting installations become effective, or during the twelve-month\n\nperiod immediately thereafter; and\n\n4. The rules for inspection, maintenance and repair of\n\ninstalled boilers and pressure vessels shall be based upon and\n\nfollow generally accepted national standards as promulgated by the\n\nNational Board of Boiler and Pressure Vessel Inspectors or by the\n\nAmerican Petroleum Institute Pressure Vessel Inspection Code as a\n\nminimum as relates to boiler and pressure vessels.\n\nB. Promulgation.
