Stat. tit. 40, § 40-141.9","heading":"Certificates of competency designating special","body":"inspectors and owner-user inspectors of boiler and pressure vessels\n\n– Exemption from liability.\n\nA. 1. Certificates of competency designating special\n\ninspectors of boilers and pressure vessels shall be issued by the\n\nCommissioner upon request of any authorized inspection agency, which\n\nhas been licensed or registered by the appropriate authority of this\n\nstate. All such authorized inspection agencies shall provide boiler\n\nand pressure vessel insurance coverage and be actively engaged in\n\nwriting this type coverage in this state.\n\n2. Before receiving a certificate of competency, each inspector\n\nshall receive a passing grade on the examination provided for by\n\nSection 141.10 of this title, or shall hold a commission or\n\ncertificate of competency as an inspector of boilers or pressure\n\nvessels from a state that has a standard of examination equal to\n\nthat of this state, or a commission as an inspector of boilers and\n\npressure vessels issued by the National Board of Boiler and Pressure\n\nVessel Inspectors.\n\n3. Special inspectors shall not receive any salary or expenses\n\nfrom this state, and a certificate of competency shall be valid only\n\nas long as such special inspectors are in full-time employment of an\n\nauthorized inspection agency.\n\n4. Special inspectors may inspect all boilers and pressure\n\nvessels insured by their respective authorized inspection agency.\n\n5. The inspections required pursuant to the Boiler and Pressure\n\nVessel Safety Act that are conducted incidental to the issuance or\n\nrenewal of boiler and machinery insurance shall not subject an\n\ninsurer, whether domestic or foreign, its agents or its employees to\n\nliability for damages for any act or omission in the course of\n\nperforming inspections as provided by this section. This section\n\nshall not apply if the gross negligence of the insurer, its agent or\n\nits employee created the condition that was the proximate cause of\n\nthe injury, death or loss.\n\n6. The insurance company shall apply on or before January 31 of\n\neach year for renewal of certificates of competency for each special\n\ninspector employed who inspects boilers and pressure vessels insured\n\nin this state. The fee must accompany application.\n\nB. 1. Certificates of competency designating owner-user\n\ninspectors of boilers or pressure vessels or both shall be issued by\n\nthe Commissioner upon request of any company operating boilers or\n\npressure vessels or both in this state. The owner-user shall\n\nmaintain a regularly established inspection department which is\n\nunder the supervision of one or more technically competent\n\nindividuals whose qualifications and whose organization and\n\ninspection procedures are in accordance with paragraph 4 of\n\nsubsection A of Section 141.3 of this title and acceptable to the\n\nCommissioner of Labor. Boilers and pressure vessels shall be\n\ninspected regularly and in accordance with applicable provisions of\n\nthe rules and regulations adopted by the Commissioner pursuant to\n\nthis act.\n\n2. Before receiving a certificate of competency, each inspector\n\nshall attain a passing grade on the examination provided for by\n\nSection 141.10 of this title, or shall hold a certificate of\n\ncompetency as an inspector from a state that has a standard of\n\nexamination equal to that of this state, or who holds a valid\n\ncommission issued in accordance with the constitution and bylaws of\n\nthe National Board of Boiler and Pressure Vessel Inspectors.\n\n3. A certificate of competency as an owner-user inspector shall\n\nbe issued only if, in addition to meeting the requirements in\n\nparagraph 2 of this subsection, the inspector is continuously\n\nemployed by the company and is responsible for making inspection of\n\nboilers and pressure vessels used by such company.\n\n4. Owner-user inspectors shall not receive any salary or\n\nexpenses from this state and a certificate of competency shall be\n\nvalid only as long as such owner-user inspector is employed full\neting the requirements in\n\nparagraph 2 of this subsection, the inspector is continuously\n\nemployed by the company and is responsible for making inspection of\n\nboilers and pressure vessels used by such company.\n\n4. Owner-user inspectors shall not receive any salary or\n\nexpenses from this state and a certificate of competency shall be\n\nvalid only as long as such owner-user inspector is employed full\n\ntime by a qualified owner-user inspection agency, in accordance with\n\nthe applicable provisions of the rules and regulations adopted\n\npursuant to this act.\n\n5. The owner-user inspection agency will apply on or before\n\nJanuary 31 of each year for renewal of competency for each owner-\n\nuser inspector employed in this state. The fee must accompany\n\napplication.\n\n6.
