Stat. tit. 40, § 40-142.1","heading":"Regulation of compressed natural gas fueling stations –","body":"Implementation and enforcement of Alternative Fuels Technician\n\nCertification Act – Transfer of duties and authority to Department\n\nof Labor.\n\nA. On the effective date of this act, all powers, duties,\n\nresponsibilities, records and equipment of the Corporation\n\nCommission relating exclusively to the regulation of compressed\n\nnatural gas fueling stations are hereby transferred and shall be\n\nplaced under the authority of the Department of Labor.\n\nB. On the effective date of this act, all powers, duties,\n\nresponsibilities, records and equipment of the Office of Management\n\nand Enterprise Services relating exclusively to the implementation\n\nand enforcement of the Alternative Fuels Technician Certification\n\nAct are hereby transferred and shall be placed under the authority\n\nof the Department of Labor. To the extent practicable, the transfer\n\nshall include all computer hardware and software used in regulating\n\nthe functions listed in this subsection.\n\nC. The Corporation Commission, the Commissioner of Labor and\n\nthe Director of the Office of Management and Enterprise Services may\n\ncontract for additional legal and administrative services as\n\nnecessary to effectuate the transfers as provided for in this\n\nsection.\n\nD. 1. All unexpended funds, property, furnishings, equipment,\n\nsupplies, records, and outstanding financial obligations and\n\nencumbrances of the Corporation Commission relating to the\n\nregulation of natural gas fueling stations and of the Office of\n\nManagement and Enterprise Services relating to the implementation\n\nand enforcement of the Alternative Fuels Technician Certification\n\nAct shall be transferred to the Department of Labor for the\n\ncontinuing performance of duties relating to the regulation of\n\nnatural gas fueling stations and implementation and enforcement of\n\nthe Alternative Fuels Technician Certification Act. No funds,\n\nproperty, furnishings, equipment, supplies or records may be\n\nexpended or used for any purpose other than the performance of\n\nduties and responsibilities as directed and required in this act.\n\n2. Any funds, properties, furnishings, equipment, supplies, or\n\nrecords related in any manner to the regulation of natural gas\n\nfueling stations and implementation and enforcement of the\n\nAlternative Fuels Technician Certification Act which may not be in\n\nthe current possession of the Corporation Commission or the Office\n\nof Management and Enterprise Services on the effective date of this\n\nact, but which come into the possession of the Corporation\n\nCommission or the Office of Management and Enterprise Services after\n\nthe transfer of authority to the Department of Labor as provided in\n\nthis act, shall immediately be transferred to the Department of\n\nLabor. Items subject to the immediate transfer shall include, but\n\nare not limited to, any misdirected licensing fees or payments of\n\noutstanding administrative fines.\n\nE. The Corporation Commission and the Director of the Office of\n\nManagement and Enterprise Services shall not enter into any contract\n\nor agreement relating to the regulation of natural gas fueling\n\nstations or implementation and enforcement of the Alternative Fuels\n\nTechnician Certification Act extending beyond the effective date of\n\nthe transfer without approval by the Commissioner of Labor.\n\nF. All licenses, registrations, certifications and\n\naccreditations issued by the Office of Management and Enterprise\n\nServices pursuant to the Alternative Fuels Technician Certification\n\nAct that are in effect on the effective date of this act shall\n\nremain in full force and effect and shall be enforceable by the\n\nDepartment of Labor.\n\nG. The Director of the Office of Management and Enterprise\n\nServices shall coordinate the transfer of funds, allotments,\n\npurchase orders and outstanding financial obligations and\n\nencumbrances relating to the regulation of natural gas fueling\n\nstations and the implementation and enforcement of the Alternative\nremain in full force and effect and shall be enforceable by the\n\nDepartment of Labor.\n\nG. The Director of the Office of Management and Enterprise\n\nServices shall coordinate the transfer of funds, allotments,\n\npurchase orders and outstanding financial obligations and\n\nencumbrances relating to the regulation of natural gas fueling\n\nstations and the implementation and enforcement of the Alternative\n\nFuels Technician Certification Act as transferred pursuant to the\n\nprovisions of this act.\n\nH. Upon the effective date of this act, all administrative\n\nrules promulgated by the Office of Management and Enterprise\n\nServices relating to the implementation and enforcement of the\n\nAlternative Fuels Technician Certification Act shall be enforceable\n\nby the Commissioner of Labor.
