Stat. tit. 40, § 40-142.11","heading":"Alternative Fuels Technician Examiners - Complaints -","body":"Investigations - False or fraudulent representation - Suspension or\n\nrevocation of certificate – Administrative hearing – Record of\n\naction – Reversal of revocation.\n\nA. The Commissioner of Labor or designee may suspend or revoke\n\nany license, certificate or registration for cause upon\n\nrecommendation of the Committee of Alternative Fuels Technician\n\nExaminers and shall comply with the provisions of the Administrative\n\nProcedures Act.\n\nB. The Commissioner of Labor or designee may, upon the motion\n\nof the Commissioner or designee, and shall, upon written complaint\n\nfiled by any person, investigate the business transactions of any\n\ncertified alternative fuels equipment or compression technician, or\n\nelectric vehicle technician. The results of the investigation may\n\nbe presented to the Committee and the Committee may recommend\n\nsuspension or revocation of the license, certificate or\n\nregistration. The Commissioner of Labor or designee shall suspend\n\nor revoke any certificate or registration obtained by false or\n\nfraudulent representation. The Commissioner of Labor or designee\n\nshall also suspend or revoke any certificate or registration for any\n\nof the following:\n\n1. Making a material misstatement in the application for a\n\ncertificate or registration, or the renewal of a certificate or\n\nregistration;\n\n2. Loaning or illegally using a certificate;\n\n3. Demonstrating incompetence to act as an alternative fuels\n\nequipment technician, alternative fuels compression technician, or\n\nelectric vehicle technician;\n\n4. Violating any provisions of the Alternative Fuels Technician\n\nCertification Act, or any rule or order prescribed by the Department\n\nof Labor; or\n\n5. Willfully failing to perform normal business obligations\n\nwithout justifiable cause.\n\nAny person whose alternative fuels equipment technician\n\ncertificate, alternative fuels compression technician certificate,\n\nor electric vehicle technician certificate has been revoked by the\n\nCommissioner of Labor or designee may apply for a new certificate\n\none (1) year from the date of such revocation.\n\nC. Before final action under subsections A and B of this\n\nsection, the Committee shall provide thirty (30) days written notice\n\nto the applicant or licensee involved of the intended action and\n\ngive sufficient opportunity for the person to request an\n\nadministrative hearing and to be represented by an attorney. If\n\nrequested, a hearing shall be scheduled by the Commissioner as\n\nprovided in the Administrative Procedures Act.\n\nD. In the event the Commissioner denies the application for, or\n\nrevokes or suspends, any certificate or imposes any reprimand, a\n\nrecord of the action shall be in writing and officially signed by\n\nthe Commissioner. The original copy shall be filed with the\n\nDepartment of Labor and a copy mailed to the affected applicant or\n\nlicensee within two (2) days of the final action taken by the\n\nCommissioner.\n\nE. Notice of the suspension or revocation of any license shall\n\nbe made public record.\n\nF. A suspended certificate shall be subject to expiration and\n\nmay be renewed as provided by the Alternative Fuels Technician\n\nCertification Act, regardless of the term of suspension. A renewal\n\nof a suspended certificate shall not remove the suspension term.\n\nG. Except as otherwise provided, a revoked certificate\n\nterminates on the date of revocation and cannot be reinstated. The\n\nCommissioner may reverse the revocation action. Any licensee whose\n\ncertificate is revoked may apply for a new certificate. The\n\nlicensee shall meet all requirements for a certificate as stated in\n\nthe Alternative Fuels Technician Certification Act. The Committee\n\nmay recommend issuance or denial of a new certificate. In\n\ndetermining whether to issue or deny a new certificate, the\n\nCommittee shall consider, but not be limited to, the nature,\n\ncircumstances, and gravity of the violation or violations leading to\nents for a certificate as stated in\n\nthe Alternative Fuels Technician Certification Act. The Committee\n\nmay recommend issuance or denial of a new certificate.
