Stat. tit. 40, § 40-142.16","heading":"Violations - Civil penalties - Determination of penalty","body":"amount - Surrender of certificate in lieu of fine – Administrative\n\nhearing.\n\nA. Any person who has been determined by the Commissioner of\n\nLabor or designee to have violated any provision of the Alternative\n\nFuels Technician Certification Act or any rule or order issued\n\npursuant to the provisions of the Alternative Fuels Technician\n\nCertification Act may be liable for a civil penalty of not more than\n\nOne Hundred Dollars ($100.00) for each day that said violation\n\noccurs. The maximum civil penalty shall not exceed Ten Thousand\n\nDollars ($10,000.00) for any related series of violations.\n\nB. The amount of the penalty shall be assessed by the\n\nCommissioner of Labor or designee pursuant to the provisions of\n\nsubsection A of this section, after notice and hearing. In\n\ndetermining the amount of the penalty, the Commissioner of Labor or\n\ndesignee shall include, but not be limited to, consideration of the\n\nnature, circumstances, and gravity of the violation and, with\n\nrespect to the person found to have committed the violation, the\n\ndegree of culpability, and any show of good faith in attempting to\n\nachieve compliance with the provisions of the Alternative Fuels\n\nTechnician Certification Act. All monies collected from such civil\n\npenalties shall be deposited with the State Treasurer of Oklahoma\n\nand placed in the Alternative Fuels Technician Certification\n\nRevolving Fund.\n\nC. Any certificate holder may elect to surrender his\n\ncertificate in lieu of said fine but shall be forever barred from\n\nobtaining a reissuance of said certificate.\n\nD. In addition to, or in lieu of, the civil penalties set forth\n\nin subsections A and B of this section, the Commissioner of Labor or\n\ndesignee, at the discretion of the Commissioner or designee, may\n\nassess the following fines for violations of the act:\n\n1. Failure to meet the applicable adopted minimum\n\nstandards in the installation, modification,\n\nrepair, maintenance, or renovation of an\n\nalternative fuel fill station, an electric vehicle\n\ncharge station or alternative fuel vehicle\n\nequipment, per occurrence: $200.00\n\n2. Performing the work or offering, by advertisement\n\nor otherwise, to perform the work of an alternative\n\nfuels equipment technician without valid\n\ncertification, per occurrence: $200.00\n\n3. Performing the work or offering, by advertisement\n\nor otherwise, to perform the work of an alternative\n\nfuels compression technician without valid\n\ncertification, per occurrence: $200.00\n\n4. Performing the work or offering, by advertisement\n\nor otherwise, to perform the work of an electric\n\nvehicle technician without valid certification, per\n\noccurrence: $200.00\n\n5. Performing the work or offering, by advertisement\n\nor otherwise, to perform the work of an alternative\n\nfuels installation company, partnership or\n\ncorporation without valid certification, per\n\noccurrence: $500.00\n\nE. Payment for the fines set forth in subsection D of this\n\nsection shall be due within thirty (30) days of issuance of a\n\ncitation by the Commissioner or designee. Any person wishing to\n\ncontest any of the aforementioned fines shall petition the\n\nCommissioner or designee for an administrative hearing, in writing,\n\nwithin thirty (30) days of issuance of the fine or fines. If\n\nrequested, the hearing shall then be scheduled by the Commissioner\n\nor designee as provided in the Administrative Procedures Act.\n\nF.
