Stat. tit. 40, § 40-165.2","heading":"Semimonthly or monthly payment of wages on regular","body":"paydays - Payment in money - Itemized statement of deductions -\n\nProhibited payments - Dishonored checks.\n\nEvery employer in this state shall pay all wages due their\n\nemployees, other than exempt employees and employees of nonprivate\n\nfoundations qualified pursuant to 26 U.S.C. 509(a)(1) and 26 U.S.C.\n\n170(b)(1)(A)(vi), at least twice each calendar month on regular\n\npaydays designated in advance by the employer. State, county and\n\nmunicipal employees, exempt employees, school district employees,\n\ntechnology center school district employees and employees of\n\nnonprivate foundations qualified pursuant to 26 U.S.C. 509(a)(1) and\n\n26 U.S.C. 170(b)(1)(A)(vi) shall be paid a minimum of once each\n\ncalendar month. The amount due such employees shall be paid in\n\nlawful money of the United States including payment by electronic\n\nmeans, and the employee shall not be deemed to have waived any right\n\nor rights mentioned in this section because of any contract to the\n\ncontrary. Each employer in this state, in its discretion, may pay\n\nall wages due to an employee by deposit on the payday at a financial\n\ninstitution of the employee's choice or, if the employee does not\n\nconsent or designate a financial institution, to a payroll card\n\naccount. With each payment of wages earned by such employee, the\n\nemployer shall issue to such employee a brief itemized statement of\n\nany and all deductions therefrom. An interval of not more than\n\neleven (11) days may elapse between the end of the pay period worked\n\nand the regular payday designated by the employer. The employer\n\nshall be allowed three (3) days after such payday in which to comply\n\nwith this section.\n\nNo such employer shall issue, in payment of or as evidence of\n\nindebtedness due an employee any check, cashier's check, draft, time\n\ncheck, store order, scrip, or other acknowledgment of indebtedness\n\nunless the same is payable or redeemable upon demand without\n\ndiscount and for face value in lawful money of the United States.\n\nIf an employer pays an employee with a check which is subsequently\n\nreturned to the employee or an agent thereof by reason of the\n\nrefusal of the bank upon which such check was drawn to honor the\n\nsame due to insufficient funds or a stop payment notice, the\n\nemployer shall reimburse the employee for any fees or costs incurred\n\nby the employee due to the refusal to honor the check within\n\nfourteen (14) days of the employer's notice of the bank's refusal to\n\nhonor the check.","path":["OK Code","Title 40"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os40.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"52037511852ec378a42e5dc9807f278653eb8db78a0e67ad07d6f92a86cb9726","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-40-40-165.11","next":"us-ok/okla.-stat.-tit.-40-40-165.2a"},"notice":"GroundRules: Original legal text.
