Whenever an employee's employment terminates, the employer\n\nshall pay the employee's wages in full, less offsets and less any\n\namount over which a bona fide disagreement exists, as defined by\n\nSection 165.1 of this title, at the next regular designated payday\n\nestablished for the pay period in which the work was performed\n\neither through the regular pay channels or by certified mail\n\npostmarked within the deadlines herein specified if requested by the\n\nemployee, unless provided otherwise by a collective bargaining\n\nagreement that covers the employee.\n\nB. If an employer fails to pay an employee wages as required\n\nunder subsection A of this section, such employer shall be\n\nadditionally liable to the employee for liquidated damages in the\n\namount of two percent (2%) of the unpaid wages for each day upon\n\nwhich such failure shall continue after the day the wages were\n\nearned and due if the employer willfully withheld wages over which\n\nthere was no bona fide disagreement; or in an amount equal to the\n\nunpaid wages, whichever is smaller; provided, however, that for the\n\npurpose of such liquidated damages such failure shall not be deemed\n\nto continue after the date of the filing of a petition in bankruptcy\n\nwith respect to the employer if he thereafter shall have been\n\nadjudicated bankrupt upon such petition.","path":["OK Code","Title 40"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os40.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"86d0e140a28d01ed0fc318f1c0c325e4ed9c84fbe20febd4dff1891e8412bc70","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-40-40-165.2a","next":"us-ok/okla.-stat.-tit.-40-40-165.3a"},"notice":"GroundRules: Original legal text.
