Stat. tit. 40, § 40-197.4","heading":"Definitions","body":"As used in this act:\n\n(a) \"Commissioner\" means the Commissioner of Labor;\n\n(b) \"Wage\" means compensation due to an employee by reason of\n\nhis employment, payable in legal tender of the United States or\n\nchecks on banks convertible into cash on demand at full face value,\n\nsubject to such deductions, charges or allowances as may be\n\npermitted by law;\n\n(c) \"Employ\" includes to suffer or to permit to work;\n\n(d) \"Employer\" means any individual, partnership, association,\n\ncorporation, business trust, or any person or group of persons,\n\nhiring more than ten full-time employees or equivalent at any one\n\nlocation or place of business; provided, however, if an employer has\n\nless than ten full-time employees or equivalent at any one location\n\nor place of business but does a gross business of more than One\n\nHundred Thousand Dollars ($100,000.00) annually, said employer shall\n\nnot be exempt under the provisions of this act.\n\nThis act shall not apply to employers subject to the Fair Labor\n\nStandards Act of 1938, as amended, and who are paying the minimum\n\nwage under the provisions of said act, nor to employers whose\n\nemployees are exempt under paragraph (e) of this section.\n\n(e) \"Employee\" includes any individual employed by an employer\n\nbut shall not include:\n\n(1) An individual employed on a farm, in the employ of\n\nany person, in connection with the cultivation of the soil, or in\n\nconnection with raising or harvesting any agricultural commodity,\n\nincluding raising, shearing, feeding, caring for, training, and\n\nmanagement of livestock, bees, poultry, and furbearing animals and\n\nwildlife, or in the employ of the owner or tenant or other operator\n\nof a farm in connection with the operation, management,\n\nconservation, improvement or maintenance of such farm and its tools\n\nand equipment;\n\n(2) Any individual employed in domestic service in or\n\nabout a private home;\n\n(3) Any individual employed by the United States\n\ngovernment;\n\n(4) Any individual working as a volunteer in a\n\ncharitable, religious or other nonprofit organization;\n\n(5) Any newspaper vendor or carrier;\n\n(6) Any employee of any carrier subject to regulation by\n\nPart I of the Interstate Commerce Act;\n\n(7) Any employee of any employer who is subject to the\n\nprovisions of any Federal Fair Labor Standards Act or to any Federal\n\nWage and Hour Law now in effect or enacted hereafter; and who is\n\npaying the minimum wage under the provisions of this act;\n\n(8) Any employee employed in a bona fide executive,\n\nadministrative or professional capacity, or in the capacity of\n\noutside salesman;\n\n(9) Any person employed as part-time employee not on\n\npermanent status. A part-time employee is defined as an employee\n\nwho is employed less than twenty-five (25) hours a week;\n\n(10) Any person who is less than eighteen (18) years of\n\nage and is not a high school graduate or a graduate of a vocational\n\ntraining program, and any person who is less than twenty-two (22)\n\nyears of age and who is a student regularly enrolled in a high\n\nschool, college, university or vocational training program;\n\n(11) Any individual employed in a feedstore operated\n\nprimarily for the benefit and use of farmers and ranchers; or\n\n(12) Any individual working as a reserve force deputy\n\nsheriff.","path":["OK Code","Title 40"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os40.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"f171974fcbc21d5c2f19da31fdea19795b54f1a1f2f2987ae62d1367af34bd58","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-40-40-197.3","next":"us-ok/okla.-stat.-tit.-40-40-197.5"},"notice":"GroundRules: Original legal text.
