Stat. tit. 40, § 40-2-106","heading":"Maximum benefit amount","body":"MAXIMUM BENEFIT AMOUNT.\n\nOn January 1, 2023, an otherwise eligible individual shall be\n\nentitled during any benefit year to a total amount of benefits equal\n\nto whichever is the lesser of:\n\n1. a. If prior to January 1, 2023, twenty-six (26) times the\n\nweekly benefit amount of the individual,\n\nb. If between January 1, 2023, and January 1, 2025,\n\nsixteen (16) times the weekly benefit amount of the\n\nindividual, or\n\nc. If after January 1, 2025, between sixteen (16) and\n\ntwenty (20) times the weekly benefit amount dependent\n\nupon the state's average unemployment insurance claims\n\npursuant to Section 3 of this act;\n\n2. The applicable percentage of the state's average annual wage\n\nfor the second preceding calendar year as determined by the Oklahoma\n\nEmployment Security Commission, rounded to the nearest multiple of\n\nOne Hundred Dollars ($100.00). The applicable percentage is\n\ndetermined by the conditional factor in place during the calendar\n\nyear in which the individual files for benefits. The conditional\n\nfactor is determined pursuant to the provisions of Section 3-113 of\n\nthis title. The applicable percentages for this paragraph are as\n\nfollows:\n\na. twenty-five percent (25%) during any calendar year in\n\nwhich the balance in the Unemployment Compensation\n\nFund is in excess of the amount required to initiate\n\nconditional contribution rates, pursuant to the\n\nprovisions of Section 3-113 of this title,\n\nb. twenty-three and three-fourths percent (23.75%) during\n\ncalendar years in which condition \"a\" exists,\n\nc. twenty-two and one-half percent (22.5%) during\n\ncalendar years in which condition \"b\" exists,\n\nd. twenty-one and one-fourth percent (21.25%) during\n\ncalendar years in which condition \"c\" exists, and\n\ne. twenty percent (20%) during calendar years in which\n\ncondition \"d\" exists; or\n\n3. The applicable percentage of the individual's wages for\n\ninsured work paid during the base period of the individual. The\n\napplicable percentage is determined by the conditional factor in\n\nplace during the calendar year in which the individual files for\n\nbenefits. The conditional factor is determined pursuant to the\n\nprovisions of Section 3-113 of this title. The applicable\n\npercentages for this paragraph are as follows:\n\na. fifty percent (50%) during any calendar year in which\n\nthe balance in the Unemployment Compensation Fund is\n\nin excess of the amount required to initiate\n\nconditional contribution rates, pursuant to the\n\nprovisions of Section 3-113 of this title,\n\nb. forty-seven and one-half percent (47.5%) during\n\ncalendar years in which condition \"a\" exists,\n\nc. forty-five percent (45%) during calendar years in\n\nwhich condition \"b\" exists,\n\nd. forty-two and one-half percent (42.5%) during calendar\n\nyears in which condition \"c\" exists, and\n\ne. forty percent (40%) during calendar years in which\n\ncondition \"d\" exists.","path":["OK Code","Title 40"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os40.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"60fac32b6456fbb48c692785fa4e0d1a33a6485b33a09b2e2e57f10fdd6deaf5","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-40-40-2-105.1","next":"us-ok/okla.-stat.-tit.-40-40-2-107"},"notice":"GroundRules: Original legal text.
