Stat. tit. 40, § 40-2-207","heading":"Wage requirement during base period","body":"WAGE REQUIREMENT DURING BASE PERIOD.\n\nA. The unemployed individual, during the individual's base\n\nperiod, shall have been paid:\n\n1. Taxable wages of not less than One Thousand Five Hundred\n\nDollars ($1,500.00); and\n\n2. Total wages of not less than one and one-half (1 1/2) times\n\nthe amount of wages during that quarter of the individual's base\n\nperiod in which the wages were highest.\n\nB. Notwithstanding the provisions in subsection A of this\n\nsection, an unemployed individual shall be eligible for benefits if,\n\nduring the individual's base period, he or she shall have been paid:\n\n1. Taxable wages of any amount; and\n\n2. Total wages equal to or more than the annual amount of\n\ntaxable wages that applies to any calendar year in which the claim\n\nfor unemployment benefits was filed.\n\nC. 1. If an individual lacks sufficient base period wages to\n\nestablish a claim for benefits under this section, any wages paid in\n\nthe individual's alternative base period shall be considered as the\n\nindividual's base period wages. Once the alternative base period\n\nwages are determined, those wage figures shall be used to determine\n\neligibility for benefits under subsection A or B of this section.\n\n2. If the Commission has not received wage information from the\n\nindividual's employer for the most recent calendar quarter of the\n\nalternative base period, the Commission shall accept an affidavit\n\nfrom the individual supported by wage information such as check\n\nstubs, deposit slips, or other supporting documentation to determine\n\nwages paid.\n\n3. A determination of benefits based on an alternative base\n\nperiod shall be adjusted when the quarterly wage report is received\n\nfrom the employer, if the wage information in the report differs\n\nfrom that reported by the individual.\n\n4. If alternative base period wages are established by\n\naffidavit of the individual, the employer to which the wages are\n\nattributed will have the right to protest the wages reported. If a\n\nprotest is made, the employer must provide documentary evidence of\n\nwages paid to the individual. The Commission will determine the\n\nwages paid based on the preponderance of the evidence presented by\n\neach party.\n\n5.
