(1) Effective January 1, 1978, benefits shall not be\n\npaid on the basis of services performed by an alien unless such\n\nalien is an individual who was lawfully admitted for permanent\n\nresidence at the time such services were performed, was lawfully\n\npresent for purposes of performing such services or otherwise is\n\npermanently residing in the United States under color of law at the\n\ntime such services were performed, including an alien who is\n\nlawfully present in the United States as a result of the application\n\nof the provisions of Section 203(a)(7) or Section 212(d)(5) of the\n\nImmigration and Nationality Act. Provided, that any modifications\n\nto the provisions of Section 3304(a)(14) of the Federal Unemployment\n\nTax Act as provided by Public Law 95-19 which specify other\n\nconditions or other effective dates than stated herein for the\n\ndenial of benefits based on services performed by aliens and which\n\nmodifications are required to be implemented under state law as a\n\ncondition for full tax credit against the tax imposed by the Federal\n\nUnemployment Tax Act, shall be deemed applicable under the\n\nprovisions of this subsection.\n\n(2) Any data or information required of individuals applying\n\nfor benefits to determine whether benefits are not payable to them\n\nbecause of their alien status shall be uniformly required from all\n\napplicants for benefits.\n\n(3) In the case of an individual whose application for benefits\n\nwould otherwise be approved, no determination that benefits to such\n\nindividual are not payable because of his alien status shall be made\n\nexcept upon a preponderance of the evidence.","path":["OK Code","Title 40"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os40.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"bf74c1562ed5aef36b33556c835c77eeae006ef62b073f958e412faf6b28c49a","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-40-40-2-207","next":"us-ok/okla.-stat.-tit.-40-40-2-209"},"notice":"GroundRules: Original legal text.
