Stat. tit. 40, § 40-2-209","heading":"Benefits for employees of governmental or nonprofit","body":"employers.\n\nBENEFITS FOR EMPLOYEES OF GOVERNMENTAL OR NONPROFIT EMPLOYERS.\n\nBenefits based on service in employment defined in paragraph (3)\n\nor (4) of Section 1-210 of this title, including any federally\n\noperated educational institutions, shall be payable in the same\n\namount, on the same terms and subject to the same conditions as\n\nbenefits payable on the basis of other service subject to the\n\nEmployment Security Act of 1980, except that:\n\n(1) With respect to service performed in an instructional,\n\nresearch or principal administrative capacity for an educational\n\ninstitution, benefits shall not be paid based on services for any\n\nweek of unemployment commencing during the period between two (2)\n\nsuccessive academic years, or during a similar period between two\n\nregular but not successive terms, or during a period of paid\n\nsabbatical leave provided for in the individual's contract, to any\n\nindividual if the individual performs services in the first academic\n\nyear or term and if there is a contract or a reasonable assurance\n\nthat the individual will perform services in any such capacity for\n\nany educational institution in the second academic year or term;\n\n(2) With respect to services performed in any other capacity\n\nfor an educational institution, benefits shall not be paid on the\n\nbasis of services to any individual for any week which commences\n\nduring a period between two (2) successive academic years or terms\n\nif the individual performs services in the first academic year or\n\nterm and there is a reasonable assurance that the individual will\n\nperform services in any such capacity in the second academic year or\n\nterm, except that if compensation is denied to any individual\n\npursuant to this paragraph and the individual was not offered an\n\nopportunity to perform services for the educational institution for\n\nthe second academic year or term, the individual shall be entitled\n\nto a retroactive payment of compensation for each week for which the\n\nindividual filed a timely claim for compensation and for which\n\ncompensation was denied solely by reason of this clause;\n\n(3) With respect to any services described in paragraphs (1)\n\nand (2) of this section, benefits shall not be payable on the basis\n\nof services in any capacities to any individual for any week which\n\ncommences during an established and customary vacation period or\n\nholiday recess if the individual performs services in the period\n\nimmediately before the vacation period or holiday recess, and there\n\nis a reasonable assurance that the individual will perform services\n\nin any such capacity in the period immediately following the\n\nvacation period or holiday recess;\n\n(4) With respect to any services described in paragraphs (1)\n\nand (2) of this section, benefits shall not be payable on the basis\n\nof services in any capacities as specified in paragraphs (1), (2)\n\nand (3) of this section to any individual who performed services in\n\nan educational institution while in the employ of an educational\n\nservice agency. For purposes of this paragraph, the term\n\n\"educational service agency\" means a governmental agency or\n\ngovernmental entity which is established and operated exclusively\n\nfor the purpose of providing services to one or more educational\n\ninstitutions;\n\n(5) If services are provided to or on behalf of an educational\n\ninstitution by a private for-profit entity or an entity described in\n\nparagraph (3) or (4) of Section 1-210 of this title that is not an\n\neducational institution or an educational service agency, the\n\nemployees providing these services shall not be subject to the terms\n\nand conditions as described in paragraphs (1), (2), (3) and (4) of\n\nthis section; and\nprovided to or on behalf of an educational\n\ninstitution by a private for-profit entity or an entity described in\n\nparagraph (3) or (4) of Section 1-210 of this title that is not an\n\neducational institution or an educational service agency, the\n\nemployees providing these services shall not be subject to the terms\n\nand conditions as described in paragraphs (1), (2), (3) and (4) of\n\nthis section; and\n\n(6) If an individual has employment with an educational\n\ninstitution and has employment with a noneducational employer or\n\nemployers during the base period of the individual's benefit year,\n\nthe individual may become eligible for benefits during the between-\n\nterm denial period, based only on the noneducational employment.","path":["OK Code","Title 40"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os40.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"f5eab05e6f9f4d468577645df67ae4b0f07da0e1b55fde9f48e6498e318f8821","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-40-40-2-208","next":"us-ok/okla.-stat.-tit.-40-40-2-210"},"notice":"GroundRules: Original legal text.
