Stat. tit. 40, § 40-2-210","heading":"Separation from work due to compelling family","body":"circumstances.\n\nIn addition to the eligibility provisions provided by this act,\n\nan individual shall be eligible to receive unemployment benefits, if\n\nmonetarily and otherwise eligible, if the claimant was separated\n\nfrom work due to compelling family circumstances. For purposes of\n\nthis section:\n\n1. \"Immediate family member\" means the claimant's spouse,\n\nparents and dependent children;\n\n2. \"Illness\" means a verified illness which necessitates the\n\ncare of the ill person for a period of time longer than the employer\n\nis willing to grant paid or unpaid leave;\n\n3. \"Disability\" means a verified disability which necessitates\n\nthe care of the disabled person for a period of time longer than the\n\nemployer is willing to grant paid or unpaid leave. Disability\n\nencompasses all types of disability, including:\n\na. mental and physical disabilities,\n\nb. permanent and temporary disabilities, and\n\nc. partial and total disabilities; and\n\n4. \"Compelling family circumstances\" means:\n\na. if the claimant was separated from employment with the\n\nemployer because of the illness or disability of the\n\nclaimant and, based on available information, the\n\nOklahoma Employment Security Commission finds that it\n\nwas medically necessary for the claimant to stop\n\nworking or change occupations,\n\nb. the claimant was separated from work due to the\n\nillness or disability of an immediate family member,\n\nc. if the spouse of the claimant was transferred or\n\nobtained employment in another city or state, and the\n\nfamily is required to move to the location of that job\n\nthat is outside of commuting distance from the prior\n\nemployment of the claimant, and the claimant separates\n\nfrom employment in order to move to the new employment\n\nlocation of the spouse,\n\nd. if the claimant separated from employment due to\n\ndomestic violence or abuse, verified by any reasonable\n\nevidence, which causes the individual to reasonably\n\nbelieve that the individual's continued employment\n\nwould jeopardize the safety of the individual or of\n\nany member of the individual's immediate family, or\n\ne. if the claimant separated from employment to move with\n\nthe claimant's spouse to a new location, and if the\n\nspouse of the claimant:\n\n(1) was a member of the U.S. Military, the U.S.\n\nMilitary Reserve, or the National Guard,\n\n(2) was on active duty within ninety (90) days of the\n\ndate of discharge,\n\n(3) has a service-connected disability,\n\n(4) was discharged under honorable conditions from\n\nthe military service, and\n\n(5) takes up residence at a location more than fifty\n\n(50) miles away from the claimant's former\n\nemployer for the purpose of reentering civilian\n\nlife.","path":["OK Code","Title 40"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os40.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"7a52c66851b38faa2ccef376da38681bc808e07aa890e9146e0d7da2e58186dc","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-40-40-2-209","next":"us-ok/okla.-stat.-tit.-40-40-2-301"},"notice":"GroundRules: Original legal text.
