If the Oklahoma Employment Security Commission determines\n\nthat any individual has made a false statement or representation or\n\nhas failed to disclose a material fact in violation of Section 5-102\n\nof this title, the individual shall be ineligible to receive\n\nunemployment compensation for the week that determination is made by\n\nthe Commission and for the next following fifty-one (51) weeks, and\n\nno benefit year shall be established during such period of\n\nineligibility. After a determination has been made that an\n\nindividual has violated Section 5-102 of this title in a particular\n\nbenefit year, if the Commission determines that another violation of\n\nthat section has occurred in any subsequent benefit year, the\n\nindividual shall be ineligible to receive unemployment compensation\n\nfor the week in which the subsequent determination is made by the\n\nCommission and for the next following one hundred three (103) weeks,\n\nand no benefit year shall be established during such period of\n\nineligibility.\n\nB. If the Commission makes a determination as described in\n\nsubsection A of this section, the individual shall be disqualified\n\nfor each week benefits were paid as a result of a false statement or\n\nrepresentation or a failure to disclose a material fact, and the\n\nindividual shall be deemed overpaid for the entire amount of\n\nbenefits paid as a result of claimant fraud.\n\nC. The ineligibility and disqualification set forth in\n\nsubsections A and B of this section are in addition to the penalty\n\nprovided by Section 5-102 of this title, and shall be invoked\n\nirrespective of whether such individual is prosecuted for violation\n\nof Section 5-102 of this title, when the Commission makes such a\n\ndetermination of ineligibility or disqualification.\n\nD.
