An employee discharged on the basis of a refusal to\n\nundergo drug or alcohol testing or a positive drug or alcohol test\n\nconducted in accordance with the provisions of the Standards for\n\nWorkplace Drug and Alcohol Testing Act shall be considered to have\n\nbeen discharged for misconduct and shall be disqualified for\n\nbenefits pursuant to the provisions of Section 2-406 of this title.\n\n2. In any challenge to a positive drug or alcohol test, the\n\nclaimant has the burden to prove that the test was not properly\n\nconducted. The employer must provide the chain of custody\n\ndocumentation at the request of any claimant challenging his or her\n\ntest result.\n\n3. When the claimant fails to request a confirmation test\n\npursuant to Section 556 of this title, the claimant shall not be\n\neligible for benefits.\n\nB. In any claim brought by the discharged employee for\n\ncompensation, a written report of the drug or alcohol test results\n\nshall be accepted as prima facie evidence of the administration and\n\nresults of the drug or alcohol test.
