The appeal referee to whom the appeal is assigned,\n\nafter affording the parties reasonable opportunity for a fair\n\nhearing, shall make findings and conclusions, and on the basis\n\nthereof affirm, modify, or reverse such determination; provided,\n\nhowever, that whenever an appeal involves a question as to whether\n\nservices were performed by claimant in employment or for an\n\nemployer, or as to amount of wages reported by an employer for\n\nclaimant, the tribunal referee shall give special notice of such\n\nissue and of the pendency of the appeal by mail to the employer and\n\nto the Commission, both of whom shall thenceforth be parties to the\n\nproceeding and be afforded a reasonable opportunity to adduce\n\nevidence bearing on such questions; provided, that any party who\n\nenters an appearance before the tribunal referee waives the\n\nrequirement of special notice by mail.","path":["OK Code","Title 40"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os40.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"6561dfacd7e0233f3c6fe4655617a50bbcd90ea3ea10e81d2d574085394c0a9f","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-40-40-2-603","next":"us-ok/okla.-stat.-tit.-40-40-2-605"},"notice":"GroundRules: Original legal text.
