The Commission may enter into an agreement with the\n\nDepartment of Human Services for information required pursuant to\n\nSection 240.12 of Title 56 of the Oklahoma Statutes to identify\n\npersons that owe child support obligations.\n\nB. The Commission shall deduct and withhold from any\n\nunemployment compensation payable to an individual that owes child\n\nsupport obligations the amount, if any, determined by the Department\n\nof Human Services pursuant to an agreement submitted to the\n\nCommission under 42 U.S.C., Section 654(19)(B)(i) by the state child\n\nsupport enforcement agency.\n\nC. Any amount deducted and withheld under subsection B of this\n\nsection shall be paid by the Commission to the Centralized Support\n\nRegistry pursuant to Section 413 of Title 43 of the Oklahoma\n\nStatutes.\n\nD. Any amount deducted and withheld under subsection B of this\n\nsection shall for all purposes be treated as if it were paid to the\n\nindividual as unemployment compensation and paid by such individual\n\nto the state child support enforcement agency in satisfaction of the\n\nindividual's child support obligations.\n\nE. For purposes of subsections A through D of this section, the\n\nterm \"unemployment compensation\" means any compensation payable\n\nunder the Employment Security Act of 1980, Section 1-101 of this\n\ntitle, including amounts payable by the Commission pursuant to an\n\nagreement under any federal law providing for compensation,\n\nassistance or allowances with respect to unemployment.\n\nF. This section applies only if appropriate arrangements have\n\nbeen made for reimbursement by the state child support enforcement\n\nagency for the administrative costs, as determined by the\n\nCommission, incurred by the Commission under this section which are\n\nattributable to child support obligations being enforced by the\n\nstate child support enforcement agency.\n\nG. For purposes of this section:\n\n(1) \"Child support obligations\" means only obligations which\n\nare being enforced pursuant to a plan described in 42 U.S.C.,\n\nSection 654, which has been approved by the Secretary of Health and\n\nHuman Services under 42 U.S.C., Section 651 et seq.\n\n(2) \"State child support enforcement agency\" means the Oklahoma\n\nDepartment of Human Services, which pursuant to Section 237 of Title\n\n56 of the Oklahoma Statutes is the single state agency in Oklahoma\n\noperating pursuant to a plan described in 42 U.S.C., Section 654,\n\nwhich has been approved by the Secretary of Health and Human\n\nServices under 42 U.S.C., Section 651 et seq.\n\n(3) Deductions from unemployment insurance authorized by\n\nsubsection B of this section in satisfaction of child support\n\nobligations are only those obligations defined in paragraph (1) of\n\nthis subsection, and the recipient of the deductions shall be\n\ndefined as only a state child support enforcement agency operating\n\npursuant to an approved plan described in 42 U.S.C., Section 654 and\n\nreferenced in paragraph (2) of this subsection.","path":["OK Code","Title 40"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os40.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"1446bc5527a32fb1965e123dc2cd04ed0f6e2f628238888508e1f222ace0a638","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-40-40-2-724","next":"us-ok/okla.-stat.-tit.-40-40-2-802"},"notice":"GroundRules: Original legal text.
