Stat. tit. 40, § 40-2-803","heading":"Food purchase assistance overissuances","body":"FOOD PURCHASE ASSISTANCE OVERISSUANCES.\n\nA. An individual filing a new claim for unemployment\n\ncompensation shall, at the time of filing the claim, disclose\n\nwhether or not he or she owes an uncollected overissuance of food\n\npurchase assistance benefits, as defined in 7 U.S.C., Section\n\n2022(c)(1). The Oklahoma Employment Security Commission shall\n\nnotify the state food purchase assistance agency enforcing such\n\nobligations of any individual who discloses that he or she owes food\n\npurchase assistance overissuances and who is determined to be\n\neligible for unemployment compensation.\n\nB. The Commission shall deduct and withhold from any\n\nunemployment compensation payable to an individual who owes an\n\nuncollected overissuance:\n\n1. The amount specified by the individual to the Commission to\n\nbe deducted and withheld under this section;\n\n2. The amount, if any, determined pursuant to an agreement\n\nsubmitted to the state food purchase assistance agency under 7\n\nU.S.C., Section 2022(c)(3)(A); or\n\n3. Any amount otherwise required to be deducted and withheld\n\nfrom unemployment compensation pursuant to 7 U.S.C., Section\n\n2022(c)(3)(B).\n\nC. Any amount deducted and withheld under this section shall be\n\npaid by the Commission to the appropriate state food purchase\n\nassistance agency.\n\nD. Any amount deducted and withheld under subsection B of this\n\nsection shall for all purposes be treated as if it were paid to the\n\nindividual as unemployment compensation and paid by the individual\n\nto the state food purchase assistance agency as repayment of the\n\nindividual's uncollected overissuance.\n\nE. For purposes of this section, the term \"unemployment\n\ncompensation\" means any compensation payable under this act\n\nincluding amounts payable by the Commission pursuant to an agreement\n\nunder any federal law providing for compensation, assistance, or\n\nallowances with respect to unemployment.\n\nF.
