Stat. tit. 40, § 40-226","heading":"Penalties","body":"(a) Whoever makes a false statement or representation knowing it\n\nto be false or knowingly fails to disclose a material fact, to\n\nobtain or increase any benefit or other payment under this act or\n\nunder the unemployment compensation law of any state or of the\n\nfederal government, either for himself or for any other person,\n\nshall be guilty of a misdemeanor and shall be punished by a fine of\n\nnot less than Fifty Dollars ($50.00) nor more than Five Hundred\n\nDollars ($500.00), or by imprisonment for not longer than ninety\n\n(90) days, or by both such fine and imprisonment; and each such\n\nfalse statement or representation or failure to disclose a material\n\nfact shall constitute a separate offense.\n\n(b) Any employing unit or any officer or agent of an employing\n\nunit or any other person who makes a false statement or\n\nrepresentation knowing it to be false, or who knowingly fails to\n\ndisclose a material fact, to prevent or reduce the payment of\n\nbenefits to any individual entitled thereto, or to avoid becoming or\n\nremaining a subject employer or to avoid or reduce any contribution\n\nor other payment required from an employing unit under this act or\n\nunder the unemployment compensation law of any state or of the\n\nfederal government, or who wilfully fails or refuses to make or to\n\nfurnish any reports required hereunder or to produce or permit the\n\ninspection or copying of records as required hereunder, shall be\n\nguilty of a misdemeanor and shall be punished by a fine of not less\n\nthan Fifty Dollars ($50.00) nor more than Five Hundred Dollars\n\n($500.00), or by imprisonment for not longer than ninety (90) days,\n\nor by both fine and imprisonment; and each such false statement or\n\nrepresentation or failure to disclose a material fact, and each day\n\nof such failure or refusal shall constitute a separate offense.\n\n(c) Any person who shall wilfully violate any provision of this\n\nact or any order, rule, or regulation thereunder, the violation of\n\nwhich is made unlawful or the observance of which is required under\n\nthe terms of this act, and for which a penalty is neither prescribed\n\nin this act nor provided by any other applicable statute, shall be\n\nguilty of a misdemeanor and shall be punished by a fine of not less\n\nthan Fifty Dollars ($50.00) nor more than Five Hundred Dollars\n\n($500.00), or by imprisonment for not longer than ninety (90) days,\n\nor by both such fine and imprisonment, and each day such violation\n\ncontinues shall be deemed to be a separate offense.\n\n(d) If any employer fails or refuses to file contribution and\n\nwage reports required under the provisions of this act within\n\nfifteen (15) days after written notice has been mailed to the\n\nemployer by the Commission or its representative, a penalty of ten\n\npercent (10%) on the total contributions due shall be added thereto,\n\ncollected and paid. Penalty collected pursuant to this subsection\n\nshall be paid into the Unemployment Compensation Fund.\n\n(e) If an employer fails or refuses to pay any contributions\n\nrequired under the provisions of this act after such contributions\n\nhave become delinquent within thirty (30) days after written request\n\nfor such payment had been mailed to the employer by the Commission\n\nor its representative, a penalty of five percent (5%) on the total\n\ncontributions due shall be added thereto, collected and paid.\n\nPenalty collected pursuant to this subsection shall be paid into the\n\nUnemployment Compensation Fund.\nact after such contributions\n\nhave become delinquent within thirty (30) days after written request\n\nfor such payment had been mailed to the employer by the Commission\n\nor its representative, a penalty of five percent (5%) on the total\n\ncontributions due shall be added thereto, collected and paid.\n\nPenalty collected pursuant to this subsection shall be paid into the\n\nUnemployment Compensation Fund.\n\n(f) If any employee or member of the Board of Review or the\n\nCommission or any employee of the Commission, in violation of the\n\nprovisions of Section 221 (l), makes any disclosure of information\n\nobtained from any employing unit or individual in the administration\n\nof this act, or if any person who has obtained any list of\n\napplicants for work, or of claimants or recipients of benefits,\n\nunder this act shall use or permit the use of such list for any\n\npolitical purpose, he shall be guilty of a misdemeanor and shall be\n\npunished by a fine of not less than Fifty Dollars ($50.00) nor more\n\nthan Five Hundred Dollars ($500.00), or imprisoned for not longer\n\nthan ninety (90) days, or both.","path":["OK Code","Title 40"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os40.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"37d6e10d80c33e2bad12e8141f6f27c71f001f2c8bcc8c562aeb2e51663e9a8f","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-40-40-200","next":"us-ok/okla.-stat.-tit.-40-40-3"},"notice":"GroundRules: Original legal text.
