Stat. tit. 40, § 40-365","heading":"Rethinking Paying Subminimal Wage to Persons with","body":"Disabilities Task Force — Members — Responsibilities — Report.\n\nA. There is hereby created until November 1, 2027, the\n\nRethinking Paying Subminimal Wage to Persons with Disabilities Task\n\nForce.\n\nB. The Task Force shall study and develop a plan to phase out\n\nthe practice of paying workers with disabilities subminimum wages\n\nunder 14(c) certificate programs in Oklahoma. The Task Force shall\n\nstudy, review, and make recommendations on the following, with a\n\nfocus on transitioning workers with disabilities currently being\n\npaid subminimum wages under 14(c) certificates to competitive,\n\nintegrated employment at or above minimum wage, and when\n\nappropriate, alternative meaningful day programs for those not able\n\nor wanting to move to competitive, integrated employment:\n\n1. Identify potential obstacles and negative impacts of phasing\n\nout subminimum wages and 14(c) use in Oklahoma; and\n\n2. Develop a plan for phasing out subminimum wages and 14(c)\n\nuse in Oklahoma that:\n\na. reduces potential negative impacts and maximizes the\n\npotential for successful transition to competitive,\n\nintegrated employment,\n\nb. includes alternative meaningful day programs for those\n\nindividuals who do not wish to transition to\n\ncompetitive, integrated employment or for those for\n\nwhom it is not appropriate, and\n\nc. establishes an appropriate timeline for phasing out\n\nsubminimum wages.\n\nC. The Task Force shall consist of eleven (11) members as\n\nfollows:\n\n1. The Secretary of Commerce and Workforce Development;\n\n2. A member of the Oklahoma House of Representatives, appointed\n\nby the Speaker of the House;\n\n3. A member of the Oklahoma State Senate, appointed by the\n\nPresident Pro Tempore;\n\n4. A representative from the Oklahoma Disability Law Center,\n\nappointed by the President Pro Tempore of the Oklahoma State Senate;\n\n5. A representative from the Oklahoma state chapter of the\n\nAssociation of People Supporting Employment First, appointed by the\n\nSpeaker of the House;\n\n6. A self-advocate who is currently enrolled or previously\n\nemployed at subminimum wage, appointed by the Board of the Oklahoma\n\nDevelopmental Disabilities Council;\n\n7. A parent or family member of a person with a disability who\n\nhas successfully transitioned from subminimum wage to competitive,\n\nintegrated employment, appointed by the Board of the Oklahoma\n\nDevelopmental Disabilities Council;\n\n8. A director of a program who previously held a 14(c)\n\ncertificate and successfully transitioned to community integrated\n\nemployment, appointed by the Governor;\n\n9. A private employer who employs individuals with\n\ndisabilities, appointed by the Governor;\n\n10. The Director of the Department of Human Services\n\nDevelopmental Disabilities Services or his or her designee; and\n\n11. The Director of the Oklahoma Department of Rehabilitation\n\nServices or his or her designee.\n\nD. The member of the Oklahoma House of Representatives and the\n\nmember of the Oklahoma State Senate shall serve as co-chairs of the\n\nTask Force. Appointments to the Task Force shall be made within\n\nthirty (30) days after the effective date of this act. Meetings of\n\nthe Task Force shall be held at the call of either co-chair of the\n\nTask Force. Members shall serve at the pleasure of their appointing\n\nauthorities. A majority of the members of the Task Force shall\n\nconstitute a quorum to transact business, but no vacancy shall\n\nimpair the right of the remaining members to exercise all of the\n\npowers of the Task Force. Except as otherwise provided, a vacancy\n\non the Task Force shall be filled by the original appointing\n\nauthority. If the original appointing authority fails to make an\n\nappointment within thirty (30) days after the effective date of this\n\nact, a majority of the members of the Task Force who have been\n\nappointed may fill the vacancy to the open position. Staff support\n\nfor the Task Force shall be provided by the staff of the Oklahoma\noriginal appointing\n\nauthority. If the original appointing authority fails to make an\n\nappointment within thirty (30) days after the effective date of this\n\nact, a majority of the members of the Task Force who have been\n\nappointed may fill the vacancy to the open position. Staff support\n\nfor the Task Force shall be provided by the staff of the Oklahoma\n\nHouse of Representatives and the Oklahoma State Senate. The\n\nOklahoma Department of Career and Technology Education, Oklahoma\n\nState Regents for Higher Education, Office of Disability Concerns,\n\nOklahoma Department of Rehabilitation Services, Oklahoma Health Care\n\nAuthority, Department of Human Services, and the State Use Committee\n\nof the Office of Management and Enterprise Services shall provide\n\nsupport and information as requested by the Task Force.\n\nE. Members of the Task Force shall receive no compensation for\n\nserving on the Task Force, but may receive travel reimbursement,\n\ncontingent on the availability of private funds for this purpose.\n\nF. The Task Force may seek the assistance of the Legislative\n\nService Bureau or the State Board of Education to contract with an\n\nindependent consultant as necessary to fulfill the duties specified\n\nin this section, contingent on the availability of funds.\n\nG.
