Each employer shall furnish to each of his employees\n\nemployment and a place of employment which are free from recognized\n\nhazards that are causing or are likely to cause death or serious\n\nphysical harm to his employees, commensurate with the Occupational\n\nSafety and Health Act of 1970.\n\nB. No person shall discharge, discriminate or take adverse\n\npersonnel action against any employee because such employee has\n\nfiled any complaint, or instituted or caused to be instituted any\n\nproceeding under or related to this act, or has testified or is\n\nabout to testify in any such proceeding, or because of the exercise\n\nby such employee on behalf of himself or herself or others of any\n\nright affected by this act.\n\nC. Within forty-eight (48) hours after the occurrence of an\n\nemployment accident which is fatal to one or more employees or which\n\nresults in hospitalization of five or more employees, the employer\n\nof any employees so injured or killed shall report the accident in\n\nwriting to the Oklahoma City office of the Oklahoma Department of\n\nLabor, in a manner prescribed by the Department. The Commissioner\n\nof Labor may require such additional reports as he deems necessary,\n\nincluding the official death certificate from the Oklahoma State\n\nDepartment of Health.\n\nD. No rule or standard promulgated under this act shall, or\n\nshall be deemed to, establish legal standards of conduct or legal\n\nduties, the violation of which standards or duties would constitute\n\nnegligence or gross negligence in any civil proceeding.\n\nE. Every employer having twenty-five (25) or more full- or\n\npart-time employees shall:\n\n1. Designate an employee who shall coordinate all safety\n\nprograms of the employer;\n\n2. Provide safety classes to each type or class of employee no\n\nless than quarterly, except that public schools shall only be\n\nrequired to provide safety classes or instruction to their employees\n\nduring the school year. Provided further, public school employees\n\nwho are certified personnel and are in compliance with federal OSHA\n\noccupational safety and health standards shall be exempt from such\n\nsafety classes or instruction and shall not be included in the\n\ncomputation of the number of employees set forth in subsection E of\n\nthis section for determining the requirement of such safety classes\n\nor instruction; and\n\n3. Cooperate with the Department of Labor including allowing\n\nany announced inspection of the premises for the purpose of\n\ndetermining compliance with this subsection.\n\nThe provisions of this subsection shall not apply to any\n\nhospital which is subject to the rules of the U.S. Department of\n\nHealth and Human Services, Health Care Financing Administration\n\n(HCFA), as set forth in 42 CFR Parts 405, 412, 416, 417, 440, 441,\n\n456, 482 and 489; Medicare and Medicaid Programs; Conditions of\n\nParticipation for Hospitals, Final Regulations.","path":["OK Code","Title 40"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os40.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"222cf232d4a808edc8113a498d444348a6befcb92468a40b69bd6a10fc845aa7","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-40-40-402","next":"us-ok/okla.-stat.-tit.-40-40-404"},"notice":"GroundRules: Original legal text.
