Stat. tit. 40, § 40-435","heading":"Break time and accommodations for expressing milk or","body":"breast-feeding.\n\nA. 1. An employer other than a state agency may provide\n\nreasonable unpaid break time each day to an employee who needs to\n\nbreast-feed or express breast milk for her child to maintain milk\n\nsupply and comfort. The break time, if possible, shall run\n\nconcurrently with any break time, paid or unpaid, already provided\n\nto the employee. An employer is not required to provide break time\n\nunder this section if to do so would create an undue hardship on the\n\noperations of the employer.\n\n2. Every state agency shall allow an employee who is lactating\n\nreasonable paid break time each day to use the designated lactation\n\nroom for the purpose of maintaining milk supply and comfort.\n\nB. An employer may make a reasonable effort to provide a\n\nprivate, secure, and sanitary room or other location in close\n\nproximity to the work area, other than a toilet stall, where an\n\nemployee can express her milk or breast-feed her child.\n\nC. The Department of Health shall issue periodic reports on\n\nbreast-feeding rates, complaints received, and benefits reported by\n\nboth working breast-feeding mothers and employers.\n\nD. As used in this section:\n\n1. \"Employer\" means a person engaged in business who has one or\n\nmore employees, including the state and any political subdivision of\n\nthe state;\n\n2. \"Employee\" means any person engaged in service to an\n\nemployer in the business of the employer;\n\n3. \"Reasonable\" means any effort that would not impose an undue\n\nhardship on the operation of the employer's business; and\n\n4. \"Undue hardship\" means any action that requires significant\n\ndifficulty or expense when considered in relation to factors such as\n\nthe size of the business, its financial resources, and the nature\n\nand structure of its operation.","path":["OK Code","Title 40"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os40.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"a82efb5389cda8abe6567b1f4235845b4bef3e4ba09f44f67959ebc474e57d77","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-40-40-424","next":"us-ok/okla.-stat.-tit.-40-40-450"},"notice":"GroundRules: Original legal text.
