No contractor shall abate any friable material containing\n\nasbestos without having first obtained a license to do so from the\n\nCommissioner of Labor. The Commissioner shall issue an asbestos\n\nabatement license to a qualified contractor upon proper application,\n\nas determined by the Commissioner. The Commissioner of Labor may\n\npromulgate rules establishing a schedule of administrative fees for\n\nthe application, licensing, examination, certification of asbestos\n\nabatement contractors and workers employed by a contractor for\n\nasbestos abatement, as well as a fee to be paid by contractors to\n\nthe Department of Labor for each separate containment area,\n\nglovebag, or miniature containment area of any asbestos abatement\n\nproject. The fees stated in this section on the effective date of\n\nthis act shall remain in effect until such rules become effective,\n\nat which time the fees stated in this section shall be superseded by\n\nrule. The annual fee for such license shall be Five Hundred Dollars\n\n($500.00). The fee shall be deposited into the Department of Labor\n\nRevolving Fund. A nonrefundable initial application fee of One\n\nThousand Dollars ($1,000.00) shall be charged and deposited into the\n\nDepartment of Labor Revolving Fund. The Commissioner may deny a\n\nlicense to applicants whose past abatement performance for abatement\n\nof friable asbestos does not comply with federal and other states'\n\nrequirements. A minimum waiting period shall be established at the\n\ndiscretion of the Commissioner of Labor and will be required before\n\nissuance of a license to permit the Commissioner to perform a work\n\nperformance investigation of the applicant.\n\nThe annual fee for examining and certifying workers employed by\n\na contractor for asbestos abatement shall be Twenty-five Dollars\n\n($25.00). The fee shall be deposited in the Department of Labor\n\nRevolving Fund. Uncertified workers shall not be used on any\n\nasbestos abatement projects.\n\nB. The state and political subdivisions thereof, counties and\n\npolitical subdivisions thereof and municipalities and political\n\nsubdivisions thereof, and their supervisors and employees, shall not\n\nbe exempt from any certification fees required by this section when\n\nsuch entities act as a contractor.\n\nC. A fee of Six Hundred Dollars ($600.00) shall be paid by\n\ncontractors to the Department of Labor for each separate containment\n\narea of any asbestos abatement project. The fee collected shall be\n\ndeposited by the Department of Labor into the Department of Labor\n\nRevolving Fund. There shall be a minimum number of inspections of\n\neach containment area as deemed necessary by the Commissioner of\n\nLabor. For projects which are not a part of a definite containment\n\narea, or are performed with multiple glovebags or miniature\n\ncontainments, a fee of Two Hundred Dollars ($200.00), plus Five\n\nDollars ($5.00) per such glovebag or miniature containment, shall be\n\npaid to the Department of Labor for deposit into the Department of\n\nLabor Revolving Fund.\n\nAsbestos abatement projects performed on properties owned by the\n\nstate or any political subdivision thereof shall not be exempt from\n\nthis fee.\n\nD. Any asbestos abatement contractor transporting asbestos-\n\ncontaining material shall be required to provide to the Commissioner\n\na Certificate of Insurance by a carrier licensed to do business in\n\nthe State of Oklahoma demonstrating a minimum of One Million Dollars\n\n($1,000,000.00) of environmental impairment insurance.\n\nE.
