The Commissioner of Labor shall have the power and duty to:\n\n1. Develop and promulgate rules for the abatement of friable\n\nasbestos materials which shall be consistent with general industry\n\nstandards;\n\n2. Instruct and examine contractors, employees and supervisors\n\non the safe abatement of friable asbestos materials;\n\n3. Hire sufficient personnel to carry out the provisions of\n\nthis act consistent with funds allocated and full-time-equivalent\n\nemployees authorized;\n\n4. Inspect all asbestos abatement projects, to issue, modify\n\nand revoke orders; to issue cease and desist orders; and to require\n\nmandamus and seek injunctive relief for enforcement of orders;\n\n5. Inspect public buildings for the presence of friable\n\nasbestos materials;\n\n6. Collect samples to determine the presence and condition of\n\nfriable asbestos materials in public buildings;\n\n7. Recommend appropriate abatement measures for friable\n\nasbestos materials in public buildings;\n\n8. Make and enter into all contracts and agreements necessary\n\nor incidental to the performance of the Department's duties and the\n\nexecution of its powers under the Oklahoma Asbestos Control Act\n\nincluding, but not limited to, contracts with the United States,\n\nother states, agencies, and political subdivisions of this state;\n\n9. Accept grants from the United States government, its\n\nagencies and instrumentalities, and any other source. To these\n\nends, the Department shall have the power to comply with such\n\nconditions and execute such agreements as may be necessary and\n\ndesirable;\n\n10. Supervise, administer, and enforce the provisions of the\n\nOklahoma Asbestos Control Act rules promulgated thereunder;\n\n11. Hold hearings;\n\n12. Institute legal proceedings, including suits for\n\ninjunctions for the enforcement of his orders, rules, and for the\n\nenforcement of penalties;\n\n13. Investigate any violations of the Oklahoma Asbestos Control\n\nAct;\n\n14. Exercise all incidental powers which are necessary to carry\n\nout the provisions of the Oklahoma Asbestos Control Act; and\n\n15. To perform such other duties as the Commissioner of Labor\n\nmay determine are essential to the protection of health from hazards\n\nposed by friable asbestos materials.\n\nB. The violations of any rule shall be grounds for the\n\nCommissioner to evoke any penalties set forth in Section 456 of this\n\ntitle.\n\nC.
