Stat. tit. 40, § 40-461","heading":"Definitions","body":"As used in Sections 460 through 473 of this title:\n\n1. \"Amusement ride\" means a device or combination of devices or\n\nelements that carry, convey, or direct a person or persons over or\n\nthrough a fixed or restricted course or within a defined area for\n\nthe primary purpose of amusement or entertainment. Amusement ride\n\nincludes any amusement park device that uses water as the means of\n\ntransportation, including the structure of the device. Amusement\n\nride does not include the operation of articles of husbandry\n\nincidental to any agricultural operation or the operation of\n\namusement devices of a permanent nature which are subject to\n\nbuilding regulations issued by cities or counties and existing\n\napplicable safety orders. Amusement ride shall be divided into the\n\nfollowing four categories:\n\na. \"permanent amusement device\" means a device which is\n\nused, or intended to be used, as an amusement device\n\nthat is erected to remain a lasting part of the\n\npremises,\n\nb. \"temporary amusement device\" means a device which is\n\nused as an amusement device that is regularly\n\nrelocated with or without disassembly,\n\nc. \"inflatable amusement device\" means an inflatable\n\namusement device as defined in Section 472 of this\n\ntitle, and\n\nd. \"other amusement device\" means amusement devices\n\nregistered with the Department of Labor that have\n\nproof of insurance.\n\nThe Commissioner of Labor may, by administrative regulation,\n\ndesignate other rides and attractions that are not included in the\n\ndefinition of amusement ride;\n\n2. \"Operator\" or \"owner\" means a person who owns or controls or\n\nhas the duty to control the operation of an amusement ride and\n\nincludes the state and every state agency, and each county, city and\n\nall private or public corporations and political subdivisions;\n\n3. \"Certificate of inspection\" means a certificate issued by\n\nthe Commissioner of Labor which indicates that an inspection of the\n\nride has been performed pursuant to rules and regulations adopted by\n\nthe Department of Labor; and\n\n4. \"Permanent amusement park ride\" means an amusement ride\n\nwhich is stationary or cannot be easily moved and which is located\n\non the same premises on which it is operated for no less than ninety\n\n(90) days.","path":["OK Code","Title 40"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os40.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"10d3d2faa7e9f45e57e25485578dd2766f49c3d572ebc6d3ca6e15dbacab62f8","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-40-40-460.4","next":"us-ok/okla.-stat.-tit.-40-40-462"},"notice":"GroundRules: Original legal text.
