The Commissioner of Labor shall determine the date and\n\nfrequency of inspections based on the type of amusement ride. No\n\npermanent or temporary amusement device may operate without an\n\ninitial inspection. On or before a date specified by the\n\nCommissioner of Labor, an operator or owner shall apply for a\n\ncertificate of inspection on a form furnished by the Commissioner of\n\nLabor.\n\nB. \"Other amusement devices\" as defined in Section 461 of this\n\ntitle shall be registered annually with the Department of Labor, and\n\nthe owner or operator shall provide to the Department of Labor proof\n\nof insurance as provided under Section 467 of this title. The\n\nCommissioner of Labor may promulgate rules providing for\n\nregistration of such devices.\n\nC. The owner or operator may make application to the\n\nCommissioner for less frequent inspections than are required under\n\nsubsection B of this section. The Commissioner, upon investigation\n\nand/or hearing of the matter, may grant a waiver, provided equal\n\npublic safety is maintained. Such waiver shall provide specific\n\nrequirements for inspection in lieu of the requirements of\n\nsubsection B of this section. The Commissioner shall promulgate\n\nrules for the determination of a waiver provided such rules place an\n\naffirmative responsibility on the owner/operator for the\n\npreservation of public safety.\n\nD. The Commissioner of Labor may cause the inspection herein\n\nprovided for to be made by the Commissioner's safety inspectors or\n\nby any qualified amusement ride inspector employed by an insurance\n\ncompany.\n\nE.
