As used in this section:\n\n1. “ASTM Standards” means the American Society for Testing of\n\nMaterials International (ASTM) standards entitled “Standard Practice\n\nfor Ownership and Operation of Amusement Rides and Devices”\n\ncurrently designated F 770, and any amendments, supplements,\n\nreplacements or substitutions therefor;\n\n2. “Operating fact sheet” means a written description and\n\nsummary of the manufacturer’s recommended operating instructions and\n\nspecifications and the ride operation policies, procedures, safety\n\nprocedures and emergency procedures prepared in accordance with the\n\nASTM Standards;\n\n3. “Amusement ride operator” or “ride operator” means a person\n\nwho is physically in control of the starting, stopping and\n\nperformance of the amusement ride while in operation; provided\n\nhowever, ride operator shall not include persons fulfilling\n\nancillary functions in connection with the amusement ride such as\n\ntaking tickets or assisting passengers in loading and unloading;\n\n4. “Amusement ride” means an amusement ride as defined in\n\nSection 461 of Title 40 of the Oklahoma Statutes; provided however,\n\nthe term amusement ride shall not include inflatable amusement\n\ndevices; and\n\n5. “Inflatable amusement device” means an amusement ride or\n\ndevice consisting of air-filled structures designed for commercial\n\nuse where the public pays a price to rent or use such a device as\n\nspecified by the manufacturer, and may include, but not be limited\n\nto, bounce, climb, slide or interactive play. They are made of\n\nflexible fabric, kept inflated by continuous air flow by one or more\n\nblowers and rely upon air pressure to maintain their shape.\n\nB. All amusement rides must be under the control of a competent\n\nride operator or competent ride operators at all times when the\n\namusement ride is in operation. The ride operator must have been\n\nissued a certificate of training pursuant to subsection F of this\n\nsection evidencing that the ride operator has been trained pursuant\n\nto subsections C and D of this section within one (1) year from the\n\ntime of his or her operation of the amusement ride or rides in\n\nquestion. Each such ride operator must wear a name tag identifying\n\nthe ride operator by name and identifying the fact that such person\n\nis a trained ride operator.\n\nC. Each owner/operator shall provide or cause to be provided\n\ntraining for each ride operator in the safe operation of the\n\namusement ride being operated. The minimum requirement for training\n\nshall be that specified in the then most current ASTM Standard.\n\nSuch training shall include, but not be limited to, the following,\n\nwhere applicable:\n\n1. Instruction on ride or device operating procedures pursuant\n\nto the operating fact sheet and any manufacturer’s operating manual,\n\nsupplements, alerts and bulletins applicable to the amusement ride;\n\n2. Instructions on specific duties of the assigned position;\n\n3. Instructions on general safety procedures;\n\n4. Instructions on emergency procedures; and\n\n5. Demonstration of the physical ride or device operation.\n\nD. Each owner/operator shall ensure that each ride operator on\n\na ride-specific basis has:\n\n1. Read and understood the operating fact sheet and has\n\nsatisfactorily demonstrated with on-the-job training and testing\n\nthat such ride operator is competent and understands the operating\n\nfact sheet;\n\n2. Demonstrated how to do pre-startup operational ride checks\n\nand daily maintenance inspection;\n\n3. Demonstrated understanding emergency procedures relating to\n\nthe amusement ride in question and has knowledge of use and function\n\nof normal and emergency operating controls; and\n\n4. Demonstrated the physical operation of the amusement ride in\n\nquestion in a safe and satisfactory manner.\n\nE. Each owner/operator shall maintain written records\n\nevidencing the compliance with subsections C and D of this section\nd understanding emergency procedures relating to\n\nthe amusement ride in question and has knowledge of use and function\n\nof normal and emergency operating controls; and\n\n4. Demonstrated the physical operation of the amusement ride in\n\nquestion in a safe and satisfactory manner.\n\nE. Each owner/operator shall maintain written records\n\nevidencing the compliance with subsections C and D of this section\n\nwith respect to each ride operator and each amusement ride for which\n\nsuch operator has been trained. These written records shall be\n\nmaintained on the premises where the amusement ride or amusement\n\nrides are being operated and made available upon reasonable request\n\nby Department of Labor amusement ride inspectors.\n\nF. In addition to the written records required pursuant to\n\nsubsection E of this section, the owner/operator shall:\n\n1. Provide to each ride operator trained pursuant to\n\nsubsections C and D of this section a written certificate stating\n\nthat the holder of this certificate has been trained in accordance\n\nwith the requirements of this section. This certificate shall be\n\ndated the date on which the training and demonstration of these\n\nskills were completed. The certificate may include additional\n\namusement rides as to which such ride operator has been trained,\n\nprovided that the separate date and location of such training is\n\nspecified. Each certificate will indicate the applicant’s name,\n\naddress, date of birth and each of the amusement rides such operator\n\nis approved to operate and the signatures of the owner/operator\n\nrepresentative and the ride operator; and\n\n2. Maintain the originals or duplicates of the above\n\ncertificate on the premises and available for inspection by\n\nDepartment of Labor amusement ride inspectors.\n\nG. The Commissioner of Labor may, where there is reasonable\n\ngrounds to believe that a ride operator is operating an amusement\n\nride while under the influence of drugs or alcohol, require such\n\nride operator to submit for voluntary drug and alcohol testing by a\n\ncompetent, qualified facility and pursuant to standards and\n\nprocedures consistent with operating a motor vehicle in this state.\n\nFailure to submit to a voluntary drug or alcohol test under such\n\ncircumstance shall result in the termination of such ride operator’s\n\ncertification for a period of ninety (90) days. A positive test for\n\ndrugs and alcohol pursuant to the foregoing shall result in a loss\n\nof such certification for a period of at least thirty (30) days and\n\nuntil the applicant passes a subsequent drug and alcohol test, which\n\nretest shall be at the expense of the applicant.","path":["OK Code","Title 40"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os40.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"45b2b522898cf32a12af1b03caa9382fa81a7499b3e4be3ac3939581eb089d5b","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-40-40-470","next":"us-ok/okla.-stat.-tit.-40-40-473"},"notice":"GroundRules: Original legal text.
