Stat. tit. 40, § 40-5-102","heading":"False statement for benefits, failure to disclose","body":"material fact.\n\nFALSE STATEMENT FOR BENEFITS, FAILURE TO DISCLOSE MATERIAL FACT.\n\nA. Whoever makes a false statement or representation knowing it\n\nto be false or knowingly fails to disclose a material fact, to\n\nobtain or increase any benefit or other payment under this act or\n\nunder the unemployment compensation law of any state or of the\n\nfederal government, either for the individual or for any other\n\nperson, shall, upon conviction, be guilty of a misdemeanor and shall\n\nbe punished by a fine of not less than Fifty Dollars ($50.00) nor\n\nmore than Five Hundred Dollars ($500.00), or by imprisonment for not\n\nmore than ninety (90) days, or by both such fine and imprisonment;\n\nand each such false statement or representation or failure to\n\ndisclose a material fact shall constitute a separate offense for\n\neach week of benefits.\n\nB. If a person is convicted of the crime described in\n\nsubsection A of this section in a particular benefit year, and in\n\nany subsequent benefit year that person again commits the crime\n\ndescribed in subsection A of this section, that person shall be\n\nguilty of a misdemeanor and shall be punished by a fine of not less\n\nthan One Hundred Dollars ($100.00) nor more than One Thousand\n\nDollars ($1,000.00), or by imprisonment for not more than one\n\nhundred eighty (180) days, or by both fine and imprisonment. Each\n\nsuch false statement or representation or failure to disclose a\n\nmaterial fact shall constitute a separate offense for each week of\n\nbenefits.\n\nC.
