It shall be unlawful for an employer to:\n\n1. Discharge any individual, or otherwise disadvantage any\n\nindividual, with respect to compensation, terms, conditions or\n\nprivileges of employment because the individual is a nonsmoker or\n\nsmokes or uses tobacco products during nonworking hours; or\n\n2. Require as a condition of employment that any employee or\n\napplicant for employment abstain from smoking or using tobacco\n\nproducts during nonworking hours.\n\nB.
