Stat. tit. 40, § 40-52","heading":"Definitions","body":"\n\nFor the purpose of and when used in this act:\n\n(a) \"Employee\", as used in this act, shall mean any person\n\nperforming or applying for work or service of any kind or character\n\nfor hire.\n\n(b) \"Employer\" shall mean any person employing or seeking to\n\nemploy any person for hire.\n\n(c) \"Fees\" shall mean anything of value, including any money or\n\nother valuable consideration exacted, charged, collected or received\n\ndirectly or indirectly, or paid or promised to be paid for any\n\nservices or act described or enumerated in subsection (e) of this\n\nsection.\n\n(d) \"Employment\" shall mean the act of employing or state of\n\nbeing employed, engaged, or hired.\n\n(e) \"Private employment agency\" shall mean any business\n\noperated in this state by any person, firm or corporation for profit\n\nwhich secures employment or by any form of advertising holds itself\n\nout to applicants as able to secure employment or to provide\n\ninformation or service of any kind purporting to promote, lead to or\n\nresult in employment for the applicant with any employer other than\n\nitself, where any applicant may become liable for the payment of a\n\nfee to the private employment agency, either directly or indirectly.\n\n\"Private employment agency\" does not include:\n\n(1) Any educational, religious, charitable, fraternal or\n\nbenevolent organization which charges no fee for\n\nservices rendered in securing employment or providing\n\ninformation about employment; or\n\n(2) Any employment service operated by this state, the\n\nGovernment of the United States, or any city, county,\n\nor town, or any agency thereof; or\n\n(3) Any temporary help service that at no time advertises\n\nor represents that its employee, with the approval of\n\nthe temporary help service, may be employed by one of\n\nits client companies on a permanent basis; or\n\n(4) Any newspaper of general circulation or other business\n\nengaged primarily in communicating information that\n\ndoes not purport to adapt the information provided to\n\nthe needs or desires of an individual subscriber; or\n\n(5) Employment offices that charge no fee to the applicant\n\nother than union dues or to the employer and which are\n\nused solely for the hiring of employees under a valid\n\nunion contract by the employer subscribing to this\n\ncontract; or\n\n(6) Any organization that charges fees only for services\n\nother than securing employment; provided that such\n\nservices are performed pursuant to a contract which\n\nincludes a statement, in a type size no smaller than\n\nten point, directly above the place for the signature\n\nof the client that reads as follows: \"I have read and\n\nreceived a copy of this contract which I understand\n\nmakes me legally obligated to pay a fee, I further\n\nunderstand that this contract does not guarantee\n\nemployment\"; or\n\n(7) Resume services whose service includes only the\n\npreparation and production of resumes, and does not\n\npurport to offer services that will result in\n\nemployment; or\n\n(8) A person employing individuals to render part-time or\n\ntemporary personal services to, for, or under the\n\ndirection of a third person, if the person employing\n\nthe individuals, in addition to wages or salaries,\n\npays federal social security taxes, state and federal\n\nunemployment insurance, carries workers' compensation\n\ninsurance as required by state law, and has\n\nresponsibility for the acts of his employees while\n\nrendering services to or under the direction of a\n\nthird person.\n\n(f) \"Temporary employment\" shall mean any period of employment\n\nterminating at any time within sixty (60) days from date of\n\nemployment.\n\n(g) \"Permanent employment\" shall mean all employment exceeding\n\nsixty (60) days duration.\n\n(h) \"Person\" shall mean any individual, copartnership,\n\ncorporation, or other legal entity.","path":["OK Code","Title 40"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os40.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"8561217d07c9582763cc349229cc42e1d505d4b11674e5c8c9d2b221f49e5c72","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-40-40-503","next":"us-ok/okla.-stat.-tit.-40-40-54"},"notice":"GroundRules: Original legal text.
