Any employer that requests or requires an applicant or\n\nemployee to undergo drug or alcohol testing shall first adopt a\n\nwritten policy setting forth the specifics of its drug or alcohol\n\ntesting program, which may include, but is not limited to, the\n\nfollowing information:\n\n1. A statement of the employer's policy respecting drug or\n\nalcohol use by employees;\n\n2. Which applicants and employees are subject to testing;\n\n3. Circumstances under which testing may be requested or\n\nrequired;\n\n4. Substances which may be tested. It shall be sufficient for\n\nan employer to state in the written policy that the substances\n\ntested shall be for drugs and alcohol;\n\n5. Testing methods and collection procedures to be used;\n\n6. Consequences of refusing to undergo testing;\n\n7. Potential adverse personnel action which may be taken as a\n\nresult of a positive test result;\n\n8. The ability of an applicant and employee to explain, in\n\nconfidence, the test results;\n\n9. The ability of an applicant and employee to obtain copies of\n\nall information and records related to that individual's testing;\n\n10. Confidentiality requirements; and\n\n11. The available appeal procedures.\n\nB. An employer who implements a drug or alcohol testing policy\n\nor changes its policy, shall provide at least ten (10) days' notice\n\nto its employees and shall provide a copy of its policy to each\n\napplicant upon his or her acceptance of employment by:\n\n1. Hand-delivery of a paper copy of the policy or changes to\n\nthe policy;\n\n2. Mailing a paper copy of the policy or changes to the policy\n\nthrough the U.S. Postal Service or a parcel delivery service to the\n\nlast address given by the employee or applicant;\n\n3. Electronically transmitting a copy of the policy through an\n\ne-mail or by posting on the employer’s website or intranet site; or\n\n4.
