The State Board of Health shall have the power and duty to\n\npromulgate, prescribe, amend and repeal rules for the licensure and\n\nregulation of testing facilities, which shall include, but not be\n\nlimited to, the following:\n\n1. Qualifications of testing facilities which shall include the\n\nrequirement that facilities doing urine analysis tests be certified\n\nfor forensic urine drug testing pursuant to guidelines or\n\nregulations of the federal Department of Health and Human Services\n\nor be accredited for forensic urine drug testing by the College of\n\nAmerican Pathologists or other organizations recognized by the State\n\nBoard of Health;\n\n2. Qualifications of testing facility personnel; and\n\n3. Procedures for the testing facility to provide the necessary\n\ndocumentation of testing procedures and test results to the employer\n\nrequesting testing services as may be required by a court or\n\nadministrative proceeding.\n\nB. Nothing in the Standards for Workplace Drug and Alcohol\n\nTesting Act shall be construed as prohibiting an employer from\n\nadopting a policy which allows for testing for drugs or alcohol by\n\nanother method which is reasonably calculated to detect the presence\n\nof drugs or alcohol, including, but not limited to, breathalyzer\n\ntesting, testing by use of a single-use test device, known as an on-\n\nsite or quick testing device, to collect, handle, store and ship a\n\nsample collected for testing.","path":["OK Code","Title 40"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os40.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"83643acdb4206b0f96b374624f36806ad26ec01d7a3a8c72927c0a3d7dd3174e","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-40-40-556","next":"us-ok/okla.-stat.-tit.-40-40-558"},"notice":"GroundRules: Original legal text.
