Stat. tit. 40, § 40-559","heading":"Sample collection and testing - Conditions","body":"All sample collection and testing for drugs and alcohol pursuant\n\nto the provisions of this act shall be conducted in accordance with\n\nthe following conditions:\n\n1. Samples shall be collected and tested only by individuals\n\ndeemed qualified by the State Board of Health and may be collected\n\non the premises of the employer;\n\n2. Only samples deemed appropriate by the State Board of Health\n\nfor drug and alcohol testing shall be collected;\n\n3. The collection of samples shall be performed under\n\nreasonable and sanitary conditions;\n\n4. A sample shall be collected in sufficient quantity for\n\nsplitting into two separate specimens, pursuant to rules of the\n\nState Board of Health, to provide for any subsequent independent\n\nanalysis in the event of challenge of the test results of the main\n\nspecimen;\n\n5. Samples shall be collected and tested with due regard to the\n\nprivacy of the individual being tested. In the instances of\n\nurinalysis, no employer or representative, agent or designee of the\n\nemployer shall directly observe an applicant or employee in the\n\nprocess of producing a urine sample; provided, however, collection\n\nshall be in a manner reasonably calculated to prevent substitutions\n\nor interference with the collection or testing of reliable samples;\n\n6. Sample collection shall be documented, and the documentation\n\nprocedures shall include:\n\na. labeling of samples so as reasonably to preclude the\n\nprobability of erroneous identification of test\n\nresults, and\n\nb. an opportunity for the applicant or employee to\n\nprovide notification of any information which the\n\napplicant or employee considers relevant to the test,\n\nincluding identification of currently or recently used\n\nprescription or nonprescription drugs, or other\n\nrelevant information;\n\n7. Sample collection, storage, and transportation to the\n\ntesting facility shall be performed so as reasonably to preclude the\n\nprobability of sample contamination or adulteration;\n\n8. Sample testing shall conform to scientifically accepted\n\nanalytical methods and procedures. Testing shall include\n\nconfirmation of any positive test result by gas chromatography, gas\n\nchromatography-mass spectroscopy, or an equivalent scientifically\n\naccepted method of equal or greater accuracy as approved by Board\n\nrule, at the cutoff levels as determined by Board rule, before the\n\nresult of any test may be used as a basis for refusal to hire a job\n\napplicant or any action by an employer pursuant to Section 12 of\n\nthis act; and\n\n9.
